Section 1. Be it enacted by the General Assembly of Maryland,
That Section 159 (c) of Article 2B of the Annotated Code of Mary-
land (1964 Supplement), title "Alcoholic Beverages," subtitle " County
Liquor Control Boards and Dispensaries," be and it is hereby repealed
and re enacted with amendments, to read as follows:
THAT SECTIONS 159(C), (D), (E), (F), (H) AND (I) AND
161 (A-1) OF ARTICLE 2B OF THE ANNOTATED CODE OF
MARYLAND (1957 EDITION AND 1965 SUPPLEMENT), TITLE
"ALCOHOLIC BEVERAGES," SUBTITLE "COUNTY LIQUOR
CONTROL BOARDS AND DISPENSARIES," BE AND THEY
ARE HEREBY REPEALED AND RE-ENACTED, WITH
AMENDMENTS, TO READ AS FOLLOWS:

(c) The members of the respective boards shall be appointed by
the Governor with the advice and consent of the Senate. Provided,
that in Somerset County they shall be appointed by the Governor.
In Harford County they shall be appointed by the Board of County
Commissioners. In Garrett County, [the County Commissioners shall
be ex offico the members of the liquor control board] the appoint-
ment shall be confirmed by the House of Delegates, if there is no
resident senator, and at least one member shall be a member of the
political party which receives the second largest number of votes in
the immediately preceding general election for senator, except if the
confirmation is made by the House of Delegates one member shall
be a member of the political party which received the second largest
number of votes for delegate in such election. THE MEMBERS OF
THE BOARD SHALL BE APPOINTED BY THE GOVERNOR. HE
SHALL APPOINT TWO MEMBERS OF THE BOARD WHO ARE
MEMBERS OF THAT POLITICAL PARTY WHICH HAS
ELECTED A MAJORITY OF THE MEMBERS OF THE BOARD
OF COUNTY COMMISSIONERS AND ONE MEMBER OF THE
BOARD FROM THAT POLITICAL PARTY OTHER THAN THE
ONE ELECTING A MAJORITY OF THE BOARD OF COUNTY
COMMISSIONERS. THE APPOINTMENTS SHALL BE CON-
FIRMED BY THE MEMBERS OF THE HOUSE OF DELEGATES
ELECTED FROM THE COUNTY IF THERE IS NO RESIDENT
SENATOR ELECTED FROM THE COUNTY. In Kent County the
County Commissioners shall be ex officio the members of the liquor
control board. In Harford County said board shall also be known as
the board of license commissioners of Harford County, upon which
shall be devolved all the duties and rights given elsewhere in this
article. In Montgomery County the director of the department of
liquor control shall be appointed and removed by the county manager
with the approval of the county council.
(D) IN COMPUTING THE TIME AT WHICH APPOINT-
MENTS TO THE SEVERAL BOARDS NORMALLY EXPIRE,
AND WHEN NEW TERMS OF OFFICE BEGIN, THE FOLLOW-
ING DATES SHALL BE USED:
(½) CAROLINE COUNTY—May 1, 1964; PROVIDED, THAT
INITIAL APPOINTMENTS SHALL BE FOR TERMS EXPIRING
RESPECTIVELY ON MAY 1, 1964, MAY 1, 1965, AND MAY 1,
1966.
