Maryland (1957 Edition and 1965 Supplement), title "Alcoholic
Beverages," subtitle "Beer, Wine and Liquor Licenses, Class B," be
and it is hereby repealed and re-enacted, with amendments; and that
new Section 19(i) (4) of said Article and subtitle, be and it is
hereby enacted, and all to read as follows:
(3) In Prince George's County there shall be, in addition to the
classes herein provided, a special Class B license known as Class
BH, which shall be issued only to hotels, and for the purpose of this
section "hotel" shall mean an establishment recognized as a hotel
for the accommodation of the public providing services ordinarily
found in hotels, equipped with not less than one hundred bedrooms,
a ballroom with not less than 2,000 square feet, a lobby with registra-
tion and mail desk and seating facilities and a dining room with
facilities for preparing and serving regular meals, wherein the aver-
age daily receipts from the hire of rooms and the sale of food
exceeds the average daily receipts from the sale of alcoholic bever-
ages; said hotel building shall consist of not less than three floors
not including floors below the street or ground level. The annual
license fee shall be twelve hundred and fifty dollars ($1,250.00).
Said licenses to be subject to all other provisions pertaining to
beer, wine and liquor licenses, Class B, in force and effect in Prince
George's County [.], except that any restrictions against the sale
of alcoholic beverages on Sunday appearing in Section 103 and else-
where in this Article shall not apply; provided, however, that alco-
holic beverages sold on Sunday shall be served only in connection
with meals in the dining area, or areas, or banquet facilities and
shall not be served in the cocktail facilities, if any, or at the bar;
and provided further that in no event may alcoholic beverages be
sold, served or consumed on the licensed premises on Sunday before
twelve o'clock noon or after twelve o'clock midnight.
(4) The Board of License Commissioners may issue to the holder
of a beer, wine and liquor license, Class B, meeting the qualifications
specified in subsection (1) of this Section a special Sunday "On-
Sale" permit to allow the holder thereof to keep for sale and to sell
at retail beer, wine and liquor on Sunday for consumption on the
licensed premises between the hours of twelve o'clock noon and twelve
o'clock midnight; providing the average daily receipts from the sale
of food exceeds the average daily receipts from the sale of alcoholic
beverages in the establishments where it is proposed to locate
such a permit, and such ratio of food sales to the sale of alcoholic
beverages has been maintained for at least six months prior to the
application for such a permit. Applicants for a special Sunday "On-
Sale" Permit shall furnish the Board of License Commissioners with
such proof as it may deem necessary indicating the qualifications
of the establishment to be issued such a permit.
Alcoholic beverages sold on Sunday under the provisions of this
section shall be sold, served and consumed only in connection with
meals in the dining area, or areas, or banquet facilities, if any.
and shall not be served in the cocktail facilities, if any, or at the bar.
The holder of a special Sunday "on-sale" Permit shall be subject
to all other provisions of this Article pertaining to beer, wine and
liquor licenses, Class B, in force and effect in Prince George's County,
except that any restrictions on the sale of alcoholic beverages on
