CHAPTER 239
(Senate Bill 402)

AN ACT to repeal and re-enact, with amendments, Section 191(e)
of Article 56 of the Annotated Code of Maryland (1957 Edi-
tion), title "Licenses", subtitle "Dog Licenses in the Counties",
and to repeal and re-enact, with amendments, Sections 194(e),
(i) and (k) of said Article and subtitle of the Code (1965 Sup-
plement), providing that fees for dog and kennel licenses in
St. Mary's County be set by the County Commissioners, grant-
ing the County Commissioners powers to prescribe rules and
regulations for the licensing or control of domestic animals
and wild animals kept in captivity in St. Mary's County, author-
izing the appointment of wardens to enforce the rules and regu-
lations so made and granting them certain powers, authorizing
restrictions upon dogs running at large in St. Mary's County,
and relating generally to the control of animals in said County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 191(e) of Article 56 of the Annotated Code of Mary-
land (1957 Edition), title "Licenses", subtitle "Dog Licenses in
the Counties", be and it is hereby repealed and re-enacted, with
amendments, and that Sections 194(e), (i) and (k) of said Article
and subtitle of the Code (1965 Supplement), be and they are
hereby repealed and re-enacted, with amendments, and all to read
as follows :

191.

(e) In St. Mary's County the license [fee for male dogs and
spayed female dogs shall be two dollars ($2.00) each and for
female dogs four dollars ($4.00) each,] fees for dogs , INCLUDING
THE FEE FOR ANY KENNEL LICENSE, shall be determined by
the County Commissioners of the County and shall be
payable on or
before the thirtieth day of June of each year, and all such licenses
issued shall be void upon the thirtieth day of June the following year.
[A kennel license shall be issued to the owner of a kennel for a fee
of ten dollars ($10.00), no matter how many dogs are included
therein, provided that all dogs so licensed shall be kept at the
kennel for which such license is issued.] The County Commissioners
of St. Mary's County are authorized and directed to appoint the
necessary agents to collect said license fees from owners of dogs who
have not paid the required license fees by the first day of August in
each year, and there shall be added to the fee of such delinquent
owner a penalty of one dollar ($1.00) per license. EVERY DOG
WARDEN APPOINTED IN ST. MARY'S COUNTY SHALL HAVE
ALL THE POWERS OF A CONSTABLE OR OTHER PEACE
OFFICER.
