County, including procedures for enforcement, inspection and de-
termination thereof and penalties for violation thereof.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 253 through 255L, inclusive, be and are hereby
added to the Code of Public Local Laws of Howard County (1965
Edition, being Article 14 of the Code of Public Local Laws of Mary-
land) , title "Howard County," subtitle and to read as follows:

253.

It is the purpose of this subtitle to protect the health, safety, and
welfare of the public by regulating the emission of air pollutants,
such as smoke, dust, particulate matter and others, into the atmos-
phere within Howard County.

254. For the purposes of this subtitle the following definitions
shall apply:

a.  Air Pollutant: Any substance the emission of which into the
atmosphere causes air pollution. It may be in the form of a smoke,
gas, dust, odor, particulate matter, or combinations of these but is
not limited to this enumeration.

b.  Air Pollution: The presence in the outdoor atmosphere of one
or more substances or combinations thereof of such character, in
such quantities, and of such duration as are or may tend to be in-
jurious to human, plant or animal life, or property, or which un-
reasonably interferes with the comfortable enjoyment of life or
property, or with the conduct of business.

c.  Nuisance: Environmental conditions, intermittent or continu-
ous, produced or correctible by human agency, prejudicial to rea-
sonable enjoyment of health, comfort, or safety by any individual or
causing injury or damage to persons, property, or the conduct of
business.

d.  Odor: Property of a substance which stimulates the sense of
smell.

e.  Open fire: A fire in which any material is burned in the open
or in a receptacle other than an approved boiler, furnace, incinerator
or other equipment connected to an approved stack, which equip-
ment is constructed in accordance with any requirements of the
Building Code for Howard County.

f.  Particulate Matter: Material, other than water, which is sus-
pended in or discharged into the atmosphere in a finely-divided form
as a liquid or solid.

g.  Process Weight Per Hour: The total weight of all material
introduced into any specific process which process may cause any
discharge into the atmosphere. Solid fuels charged will be considered
as part of the process weight, but liquid and gaseous fuels and
combustion air will not. "The process weight per hour" will be
derived by dividing the total process weight by the number of hours
in one complete operation from the beginning of any given process
