the department, as may be determined by Order promulgated by the
Police Commissioners COMMISSIONER in accordance with the au-
thority vested in him by this subtitle, shall be acting police commis-
sioner while such ABSENCE OR disability continues. In no case shall
the appointment of an acting police commissioner continue for a peri-
od longer than ninety (90) days unless approval therefore is expressly
given by the Governor , NOR IN ANY EVENT SHALL SUCH
APPOINTMENT CONTINUE BEYOND THE TERM FOR WHICH
THE POLICE COMMISSIONER WAS APPOINTED. Should the
Governor withhold such approval, he shall forthwith designate an
acting police commissioner to serve at his pleasure until the Police
Commissioner reassumes the duties and responsibilities of his officer,
BUT IN NO EVENT SHALL SUCH APPOINTMENT CON-
TINUE BEYOND THE TERM FOR WHICH THE POLICE
COMMISSIONER WAS APPOINTED. An acting police com-
missioner appointed under the provisions of this section shall
have, during the time in which he acts as police commissioner,
all the powers and duties conferred by law upon the Police Commis-
sioner. An acting police commissioner appointed from within the
department shall receive no extra compensation for his services as
such. An acting police commissioner appointed by the Governor,
who is not a member of the department, shall receive a salary during
his service which shall not be less in amount than that then author-
ized for payment to the Commissioner.

In directing and supervising the operations and affairs of the
Department, the Commissioner shall, subject to the provisions of
this subtitle, AND SUBJECT TO THE PROVISIONS OF ARTICLE
VI AND SECTIONS 4-14, BOTH INCLUSIVE, OF ARTICLE VII
OF THE CHARTER OF BALTIMORE CITY (1964 REVISION) AS
AMENDED FROM TIME TO TIME be vested with all the powers,
rights and privileges attending the responsibility of management,
and may exercise the same, where appropriate, by rule, regulation,
order or other departmental directive which shall be binding on all
members of the Department when duly promulgated. IN THE
EVENT OF A CONFLICT BETWEEN THE PROVISIONS OF
SAID ARTICLE VI AND SECTIONS 4-14, BOTH INCLUSIVE,
OF ARTICLE VII OF SAID CHARTER, AND THE PROVISIONS
OF THIS SUBTITLE, THE PROVISIONS OF SAID ARTICLE
VI AND SECTIONS 4-14 OF ARTICLE VII SHALL CONTROL.
The authority herein vested in the Police Commissioner shall specif-
ically include, but not be limited to, the following:

(a)    To determine and establish the form of organization of the
Department.

(b)    To create Bureaus, Divisions, Districts, Sections, Units,
Squads or other subordinate organizational subdivisions or segments
within the Department, including Departmental Boards and Com-
missions, and to determine and define the functions, duties and re-
sponsibilities of each.

(c)    To appoint without examination, to serve at his pleasure
during satisfactory performance, such Deputy Commissioners,
