by statute or regulation upon the Police Commissioner. He shall
be paid compensation of not less than Two Thousand Dollars

($2,000.00) monthly during his service as Acting Police Commis-

sioner, which shall be in lieu of any other salaried compensation to

which he may be entitled from the State or the City of Baltimore.

The position of Acting Police Commissioner, as provided for in

this section, shall not be considered or construed as a public office,

or office of profit, under the Constitution or laws of this State.

Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency law and necessary for the immediate preserva-
tion of the public health and safety, and having been passed by a yea

and nay vote, supported by three fifths of all the members elected to
each of the two Houses of the General Assembly of Maryland, the
same shall take effect from the date of its passage.

AN ACT TO ADD A NEW SECTION 9A TO ARTICLE 65 OF
THE ANNOTATED CODE OF MARYLAND (1964 REPLACE-
MENT VOLUME), TITLE "MILITIA," SUBTITLE "IN GEN-
ERAL," TO FOLLOW IMMEDIATELY AFTER SECTION 9
THEREOF, PROVIDING FOR A TEMPORARY PERIOD THAT
THE DUTIES OF THE ADJUTANT GENERAL OF MARYLAND
MAY INCLUDE THAT OF SERVING AS ACTING POLICE COM-
MISSIONER OF THE MAYOR AND CITY COUNCIL OF BALTI-
MORE; PROVIDING FOR HIS POWERS, DUTIES, AND FUNC-
TIONS IN THAT POSITION; REQUIRING A CERTAIN PAY-
MENT FROM THE MAYOR AND CITY COUNCIL OF BALTI-
MORE TO THE GENERAL FUNDS OF THE STATE DURING
ANY PERIOD THE ADJUTANT GENERAL IS SO ACTING, AND
RELATING GENERALLY TO THE POWERS, DUTIES, AND
FUNCTIONS OF THE ADJUTANT GENERAL AS ACTING PO-
LICE COMMISSIONER OF BALTIMORE CITY AND TO THE
DUTIES OF BALTIMORE CITY IN RESPECT THERETO.

SEC. 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, THAT A NEW SECTION 9A BE AND IT IS HEREBY
ADDED TO ARTICLE 65 OF THE ANNOTATED CODE OF MARY-
LAND (1964 REPLACEMENT VOLUME), TITLE "MILITIA," SUB-
TITLE "IN GENERAL," TO FOLLOW IMMEDIATELY AFTER
SECTION 9 THEREOF, AND TO READ AS FOLLOWS:

9A.

THE GOVERNOR OF MARYLAND MAY ASSIGN TO THE AD-
JUTANT GENERAL, FOR SUCH PERIOD AS DESIGNATED, THE
DUTY OF SERVING AS ACTING POLICE COMMISSIONER OF
THE MAYOR AND CITY COUNCIL OF BALTIMORE, WITH ALL
THE POWERS, DUTIES, AND FUNCTIONS PRESCRIBED AND
PROVIDED BY LAW FOR THAT POSITION. FOR ANY PERIOD
DURING WHICH THIS DUTY IS ASSIGNED TO AND DIS-
CHARGED BY THE ADJUTANT GENERAL, THE MAYOR AND
CITY COUNCIL OF BALTIMORE SHALL PAY OVER TO THE
GENERAL FUNDS OF THE STATE TREASURY A SUM COM-
PUTED ON THE BASIS OF TWO THOUSAND DOLLARS FOR
EACH MONTH. THE PROVISIONS OF THIS SECTION, AND THE
APPOINTMENT SHALL EXPIRE AUTOMATICALLY AS OF MAY
