The situation here and in those cases is to be distinguished from
the situation where the court reviews the action of an administra-
tive official in granting or refusing a license. See, McCrea v.
Roberts,
89 Md. 238.

While I again emphasize our feeling that the purpose of this Bill
is clearly in the public interest, we have reluctantly reached the con-
clusion that, for the reasons stated, it is unconstitutional.

Senate Bill No. 399—Student Activity Fees

AN ACT to repeal and re-enact, with amendments, Section 7 of
Article 15A of the Annotated Code of Maryland (1957 Edition),
title "Budget and Procurement," subtitle "Budgetary Administra-
tion," amending the laws concerning the accounting for certain
unestimated receipts of State agencies in order to make particular
provision for the reporting and accountability of student activity
fees at educational institutions.

Dear Mr. President:

In accordance with the provisions of Article 2, Section 17 of
the Maryland Constitution, I have today vetoed Senate Bill 399.

This Bill amends the laws concerning the accounting for certain
unestimated receipts of State agencies in order to make particular
provision for the reporting and accountability of student activity
fees at educational institutions.

The Chief of the Accounting Division, Comptroller's Office, the
Director of the Department of Budget and Procurement and the
State Auditor have all strongly urged that this Bill be vetoed. The
views of the State's chief financial officers cannot be likely dis-
missed. I am attaching a copy of their letter which is to be con-
sidered a part of this message.

For the reasons set forth in their letter, I feel compelled to
veto Senate Bill 399.
