CHAPTER 752
(House Bill 532)

AN ACT to repeal and re-enact, with amendments, Section 715A(m)
and 715C(j) of Article 66C of the Annotated Code of Maryland
(1965 Supplement), title "Natural Resources," subtitle "Oysters
and Clams"; to repeal Section 700(g) of the said article and subtitle
of the code (1957 Edition); to renumber Section 714 of the said
article and subtitle of the code (1965 Supplement), as enacted by
Chapter 829 of 1959 and last amended by Chapter 181f of 1965 to
be Section 714A, to follow immediately after the Section 714 as this
Section 714 was enacted by Chapter 828 of 1959; to correct
erroneous cross-references in the claim CLAM laws of the State,
to repeal a conflicting provision regarding the fees for an oyster
tonging license and to renumber a section of the claim CLAM laws
to avoid confusion of the law, in order to make corrections in the
oyster and clam laws of the State.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 7l5A(m) and 715C(j) of Article 66C of the Anno-
tated Code of Maryland (1965 Supplement), title "Natural Re-
sources," subtitle "Oysters and Clams," be and are hereby repealed
and re-enacted, with amendments; that Section 700(g) of the said
article and subtitle of the code (1957 Edition), be and is hereby
repealed; that Section 714 of the said article and subtitle of the
code (1965 Supplement), as enacted by Chapter 829 of 1959 and
last amended by Chapter 181f of 1965 be and is hereby renumbered as
Section 714A, to follow immediately after the Section 714 as this
Section 714 was enacted by Chapter 828 of 1959, and all to read as
follows:

715A.

(m) Any person violating any provision of [Section 715] this
Section
or the rules and regulations of the Commission of Tidewater
Fisheries
DEPARTMENT OF CHESAPEAKE BAY AFFAIRS
adopted pursuant thereto, shall be deemed guilty of a mis-
demeanor and upon conviction thereof shall be fined not less than
one hundred dollars ($100.00) nor more than one thousand dollars
($1,000.00), or be imprisoned in the house of correction not less
than three months nor more than six months, or be both fined and
imprisoned at the discretion of the court; and in addition thereto,
any boat, dredge or other device, truck, trailer, or any other thing ap-
purtenant thereto, used in connection with the violation, may be
declared forfeited to the State of Maryland and delivered to the
Commission of Tidewater Fisheries DEPARTMENT for such dis-
position thereof as, in the opinion of said Commission DEPART-
MENT, may be most advantageous to the State. All monies received
from such fines, and from the disposition of any forfeited boat,
