CHAPTER 685
(House Bill 730)

AN ACT to add new Section 24A to Article 89B of the Annotated
Code of Maryland (1964 Replacement Volume), title "State
Roads," subtitle "In General," to follow immediately after Section
24 thereof, to provide that the State Roads Commission shall in-
clude in its bid requirements a provision whereby utility sleeves
shall be installed under new State roads at intersections and other
areas in Howard County, such areas to be designated by Howard
County and the cost of the sleeves to be paid by Howard County.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 24A be and it is hereby added to Article 89B of the
Annotated Code of Maryland (1964 Replacement Volume), title
"State Roads," subtitle "In General," to follow immediately after
Section 24 thereof, and to read as follows:

24 A.

(a)     The State Roads Commission of Maryland shall include in its
specifications for new highways at intersections of existing high-
ways, and at other intervals which conform particularly to Howard
County's population growth plans, utility sleeves which will be large
enough in size to accommodate water mains, gas mains, electric
lines, telephone cables, and all other utilities that may be requested
by the governing body of Howard County, and, where possible, to
fit the growth pattern of Howard County. Sizes of the utility sleeves
shall be determined by the State Roads Commission and the govern-
ing body of Howard County.

(b)    The Commission shall install or have installed a sleeve-type
installation consisting of metal or reinforced concrete pipe or other
acceptable building material from right-of-way to right-of-way in
order to eliminate the possibility of boring and jacking under the
Commission's existing roadway, thereby eliminating the extra cost
of utility line installation contracts to be let in the future. Such
sleeves constructed for the future shall be bricked over at both ends
and properly marked by either the Commission or the proper county
agency.

(c)    Howard County shall reimburse the Commission for the cost
of the utility
sleeve SLEEVES WHICH ARE INSTALLED BY THE
COMMISSION. Utility companies shall be assessed by the county's

governing body for their share of the use of such utility sleeves and

such utility companies shall pay their share of the use of such utility

sleeves. This section is not to be construed that the private utility

companies must use said sleeves but shall do so at their discretion.

(d)     The governing bodies of Howard County and the Commis-
sion shall jointly cooperate in the exchange of plans and shall fully
cooperate with each and every agency affected by this section.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1966.
