CHAPTER 575
(Senate Bill 126)

AN ACT to repeal subsection (f) of Section 161H of Article 23 of
the Annotated Code of Maryland (1957 Edition and 1965 Supple-
ment), title "Corporations", subtitle "III. Particular Classes of
Corporations", subheading "Maryland Savings Share Insurance
Corporation";
"BUILDING OR HOMESTEAD ASSOCIATIONS";
to repeal and re-enact, with amendments, subsections (d) and
(e) of Section 161H of Article 23 of the Annotated Code of
Maryland (1957 Edition and 1965 Supplement), title "Corpo-
rations", subtitle "III. Particular Classes of Corporations", sub-
heading "Maryland Savings-Share Insurance Corporation"; to add
a new Section 59 to Article 75 of the Annotated Code of Maryland
(1965 Replacement Volume), title "Pleadings, Practice and Process
at Law", subtitle "III. Practice", to be under a new subheading
"Detinue", to follow immediately after Section 56 thereof; to add
a new Section 272A to Article 93 of the Annotated Code of Mary-
land (1964 Replacement Volume and 1965 Supplement), title "Tes-
tamentary Law", subtitle "Orphans' Court", to follow immediately
after Section 272 thereof; to amend or repeal provisions of the
Code of Public General Laws of Maryland inconsistent with cer-
tain of the Maryland Rules of Procedure and to reinstate certain
portions of provisions of the Code of Public General Laws of
Maryland erroneously repealed in prior Acts of this nature.

Section 1. Be it enacted by the General Assembly of Maryland,
That subsection (f) of Section 161H of Article 23 of the Annotated
Code of Maryland (1957 Edition and 1965 Supplement), title "Cor-
porations", subtitle "III. Particular Classes of Corporations", sub-
heading "Maryland Savings Share Insurance Corporation", "BUILD-
ING OR HOMESTEAD ASSOCIATIONS", be and it is hereby
repealed.

Sec. 2. And be it further enacted, That subsections (d) and (e)
of Section 161H of Article 23 of the Annotated Code of Maryland,
(1957 Edition and 1965 Supplement), title "Corporations", subtitle
"III. Particular Classes of Corporations", subheading "Maryland
Savings Share Insurance Corporation",
"BUILDING OR HOME-
STEAD ASSOCIATIONS", be and they are hereby repealed and
re-enacted, with amendments, to read as follows:

161H.

(d)  The association affected or the holders of at least ten per cent
(10%) of the par value of the free shares of said association shall
have the right [within thirty (30) days of the date of mailing of
any final order of the Board] to appeal from such order [by filing a
petition in] to the Circuit Court of Baltimore City or in the circuit
court for the county in which the principal Maryland office of the
association is located. [Such petition for appeal shall set forth the
action appealed from and the basis for the appeal; copies of the
petition shall be served upon the Director and all other parties of
record.]

(e)  The court to which the appeal is taken shall hear the matter
de novo, without a jury, and the parties may call such witnesses and
