984                             LAWS OF MARYLAND                     [CH. 701

of Maryland (1964 Supplement), title "State Boat Act" be and they
are hereby repealed and re-enacted, with amendments; and that
new Sections 4A through 4R 4-O, inclusive, be and they are hereby
added to the said article of the Code, to follow immediately after
Section 4 thereof, and to read as follows:

1.

As used in this article, unless the context clearly requires a
different meaning:

(a)    "Vessel" means every description of watercraft, other than
a seaplane used or capable of being used as a means of transporta-
tion on water or on ice, it being the intent that ice boats shall be
regarded as watercraft for the purposes of this article;

(b)    "Motorboat" means any vessel equipped with propelling
machinery, whether or not such machinery is the principal source
of propulsion;

(c)    "Waters of Maryland" means all waters within the jurisdic-
tion of this State, the marginal sea adjacent to this State, and the
high seas when navigated as a part of a ride or journey to or from
the shore of this State;

(d)    "Operate" means to navigate or otherwise use a vessel;

(e)    "Owner" means a person, other than a lien holder, having the
property in or title to a vessel. The term includes a person entitled
to the use or possession of a vessel subject to an interest in another
person, reserved or created by agreement and securing payment of
performance of an obligation, but the term excludes a lessee under
a lease not intended as security;

(f)     "Operator" means the person who operates or has charge
of the navigation or use of a vessel [.] ;

(g)    "Security Interest" means an interest which is reserved or
created by an agreement and which secures 'payment or 'performance
of an obligation and is valid against third parties generally;

(h) "Lienholder" means a person holding a security interest;

(i) "Person" means an individual, partnership, firm, corporation,
association, or other entity.

(j) "Commission" means the Commission on Chesapeake Bay
Affairs;

(k) "Department" means the Department of Chesapeake Bay
Affairs which is designated to issue certificates of title and certificates
of number for vessels and its duly authorized representatives;

(l) "Manufacturer" means any person engaged in the business
of manufacturing new and unused vessels, or new and unused out-
board motors, for the purpose of sale or trade;

(m) "Dealer" means any person who engages wholly or in part
in the business of buying, selling or exchanging new and unused
vessels, or used vessels, or both, and/or new and unused outboard
motors, or used outboard motors, or both, either outright or on
conditional sale, bailment, lease, chattel mortgage or otherwise, and
