Whereas, through error, inadvertence or otherwise the official
"needs study" of the State Roads Commission, when presented to
the 1964 Session of the General Assembly and as approved by the
Chairman of the State Roads Commission, provided that U. S. Route
13 between Westover and the Worcester County Line in Somerset
County be constructed as an open access highway, and
Whereas, it has been determined that in the interest of safety
this section of highway should be constructed as a Controlled Access
Arterial Highway, particularly since it is a direct connection to the
new Chesapeake Bay Bridge-Tunnel Project in Virginia, and
Whereas, this section of highway is not scheduled for construc-
tion as a four lane divided highway with control of access during
the current two year highway construction program thus leaving a
"bottleneck" which results in creating an extremely dangerous traffic
condition on this highway which is one of the main arteries of travel
between the north and the south through Maryland, and
Whereas, through error, inadvertence or otherwise, such official
"needs study" provided that the proposed Northern Thru way from
Interstate Route 95 to the Aberdeen Proving Grounds, in Harford
County, be constructed as a two lane highway whereas traffic needs
require that such highway be constructed as a four lane divided
highway with control of access and with an interchange at U. S.
Route 40.
Section 1. Be it enacted by the General Assembly of Maryland,
That two new sections be and are hereby added to Article 89B of the
Annotated Code of Maryland (1964 Replacement Volume), title
"State Roads", sub-title "Expenditure of Commission's Funds and
Programming and Scheduling of Highway Projects", said new
sections to be known as Sections 211 H(1) and 211 H(2) of said
Article, to follow immediately after Section 211 H, and to read as
follows:
211 H(1).
In order to promote the safety of the traveling public and to make
available the use of the highway as soon as is practicable the State
Roads Commission is authorized, notwithstanding the design as
shown in the official "needs study" of the State Roads Commission
and the construction schedule shown in the present State Roads
Commission highway construction program, to construct U. S. Route
13 between Westover and the Worcester County Line in Somerset
County, as a controlled access four lane divided highway. The Com-
mission is authorized to so construct such highway in part or parts,
or in its entirety, from available funds or from funds which may
become available for such purpose.
211 H(2).
In order to promote the safety of the traveling public and to make
available the use of the highway as soon as is practicable, the State
Roads Commission is authorized, notwithstanding the design as
shown in the official "needs study" of the State Roads Commission
and the construction schedule shown in the present State Roads
Commission Highway Construction Program, to construct the pro-
posed Northern Thruway from Interstate Route 95 to the Aberdeen
