CHAPTER 418
(House Bill 698)

AN ACT to repeal Sections 78 and 79 of Article 77 of the Annotated
Code of Maryland (1957 Edition), title "Public Education," sub-
title "Chapter 6. District School Trustees"; to repeal Section 77
of said Article, subtitle "Chapter 6. District School Trustees," and
to enact a new Section 77 in lieu thereof, said new section to stand
in the place of the section so repealed; to repeal and re-enact,
with amendments, Section 4 of said Article, subtitle "Chapter 1.
Control and Supervision; Free Schools"; to repeal and re-enact,
with amendments, Section 18 of said Article, subtitle "Chapter 2.
Formation of Boards"; to repeal and re-enact, with amendments,
Sections 76, 80, 81 and 82 of said Article, subtitle "Chapter 6.
District School Trustees," making the existence of district boards
of school trustees discretionary with the appropriate county boards
of education, and generally limiting and clarifying the duties and
powers of district boards of school trustees.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 78 and 79 of Article 77 of the Annotated Code of
Maryland (1957 Edition), title "Public Education," subtitle "Chapter
6. District School Trustees," be and they are hereby repealed.

Sec 2. And be it further enacted, That Section 77 of Article 77
of the Annotated Code of Maryland (1957 Edition), title "Public
Education," subtitle "Chapter 6. District School Trustees," be and
it is hereby repealed and that new Section 77 be and it is hereby
enacted in lieu thereof, to stand in the place of the section so
repealed and to read as follows:

77.

Each district board of school trustees shall seek in every way to
develop public sentiment in support of the public schools. Each such
board may visit the school under its jurisdiction at least once each
school term and may consult with the principal of said school as to
the use and general condition of the school facilities and as to the
current program of instruction. Each such board should give such
assistance as lies within its power for the advancement of the school.

Sec. 3. And be it further enacted, That Section 4 of Article 77
of the Annotated Code of Maryland (1957 Edition), title "Public
Education," subtitle "Chapter 1. Control and Supervision; Free
Schools," Section 18 of said Article, subtitle "Chapter 2. Formation
of Boards," and Sections 76, 80, 81 and 82 of said Article, subtitle
"Chapter 6. District School Trustees," be and they are hereby
repealed and re-enacted, with amendments, to read as follows:

Educational matters affecting a school district [shall] may, in
the discretion of the appropriate county board of education, be under
the care of a district board of school trustees, which district board
shall have only such powers and duties as are provided elsewhere in
this article.
