insurer is or becomes insolvent or otherwise unable to pay claims, in
like manner and to like extent as for damage caused by a motor
vehicle as to which no liability insurance exists.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 376
(House Bill 196)

AN ACT to add new Sections 707 to 717, inclusive, to Article 43 of the
Annotated Code of Maryland (1957 Edition and 1964 Supplement),
title "Health," to follow immediately after Section 706 thereof, and
to be under the new subtitle "Group Day Care Centers," providing
for the licensing and regulation of group day care centers for the
care of certain children, specifying the duties of local and State
Health officers, and of the State Board of Health and Mental
Hygiene in the administration and enforcement of this Act, and
relating generally to the licensing and regulation of group day
care centers, the requirements for establishing and operating such
facilities, and the duties of certain State and local officers in con-
nection therewith.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 707 to 717, inclusive, be and they are hereby added
to Article 43 of the Annotated Code of Maryland (1957 Edition and
1964 Supplement), title "Health," to follow immediately after Section
706 thereof, and to be under the new subtitle "Group Day Care
Centers," and to read as follows:

Declaration of Policy
707.

It is declared to be the policy of the State of Maryland that the con-
dition of childhood is such that the child is not capable of self pro-
tection, and when the child's care is given over to others, certain
mental and physical risks arise calling for reasonable protective
measures to offset these risks. Since the basic purpose is to protect
children, the measure of accomplishment of the purpose is not to limit
a parent in securing the help of responsible relatives or friends in
giving day care to his children. Rather, it is to aid parents and protect
children from the risk present when their children are cared for by
individuals other than relatives or friends and when children of more
than one family are cared for together or use the same facilities on
different days.
