CHAPTER 337
(House Bill 636)

AN ACT to repeal and re-enact, with amendments, Section 35 (a)
of Article 43 of the Annotated Code of Maryland (1957 Edition),
title "Health," subtitle "Miscellaneous Provisions"; to grant the

public health laboratory discretionary power to refuse to provide

services at times when adequate personnel and facilities are not
available. , RELATING TO THE POWER OF THE STATE
BOARD OF HEALTH AND MENTAL HYGIENE TO CONDUCT
CERTAIN INQUIRIES.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 35 (a) of Article 43 of the Annotated Code of Maryland
(1957 Edition), title "Health," subtitle "Miscellaneous Provisions";
be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

35.

(a) The State Board of Health and Mental Hygiene , TO THE EX-
TENT THAT FUNDS AND FACILITIES ARE AVAILABLE, shall
conduct inquiries into the nature, source and vehicles of infectious dis-
eases, and into the nature and character of sewage, trades wastes,
and into nuisances. It shall examine and analyze free of cost, public
and private water supplies, milk and such other foods, drinks, con-
fectionery, drugs, spices and condiments as the Board shall direct;
it shall establish and maintain a properly equipped public health
laboratory to perform these and related functions, and the services
of said laboratory shall be free to all local boards of health and to
all practicing physicians of the State for inquiries concerning in-
fectious and contagious diseases and such other matters as the said
Board may from time to time direct.

The public health laboratory may refuse any request for services

as provided in this section in the event the available personnel and

facililties, as allocated in the budget, are determined by said labor-
tory to be inadequate to handle a request.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 338
(House Bill 641)

AN ACT to repeal and re-enact, with amendments, Section 20 of
Article 36 of the Annotated Code of Maryland (1964 Supplement),
title "Fees of Officers," subtitle "Justices of the Peace," to sub-
divide such section and to provide for a flat fee payment in lieu
of the payment of certain costs in the filing of civil suits in the
magistrates' courts of Washington County, specifying the manner
