Sec. 2. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the imme-
diate preservation of the public health and safety, and having been
passed by a yea and nay vote supported by three-fifths of the
members elected to each of the two houses of the General Assembly,
the same shall take effect from the date of its passage.

CHAPTER 31
(Senate Bill 171)

AN ACT to repeal and re-enact, with amendments, Section 8-22 of
Article II of the Frederick County Code, 1959, being Article 11 of
the Code of Public Local Laws of Maryland, title "Frederick
County", sub-title "Treasurer", as last amended by Chapter 466
of the Acts of 1947; changing the date from which the county
treasurer of Frederick County shall hold office.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 8-22 of Article II of the Frederick County Code, 1959,
being Article 11 of the Code of Public Local Laws of Maryland, title
"Frederick County", sub-title "Treasurer", as last amended by Chap-
ter 466 of the Acts of 1947, be and it is hereby repealed and re-en-
acted, with amendments, to read as follows:

8-22.

The county treasurer shall hold his office from the first of [July]
December next ensuing his election for the term of four years and
until his successor in office is duly elected and qualified. He shall be
removed from office by the county commissioners upon conviction in
the circuit court for the county or in any other county having juris-
diction in the premises for any wilful neglect of duty or misbehavior
or malfeasance in office. In case of a vacancy in the office, by reason
of a removal from office as herein provided or by reason of death,
resignation, removal from the county or in any other manner, the
governor of the state shall fill such vacancy by appointment of some
person having the necessary qualification, who shall hold such office
for the remainder of the term.

Sec. 2. And be it further enacted, That this Act shall not affect
the term of office existing on the date of passage of the Act, but shall
take effect so that the term of office to which the county treasurer
shall be elected in November, 1966, shall expire December 1, 1970.

Sec. 3. And be it further enacted, That this Act shall take effect
June 1, 1965.
