288                             LAWS OF MARYLAND                     [CH. 266

CHAPTER 266
(House Bill 161)

AN ACT to repeal and re-enact, with amendments, Section 43 (a) of
Article 89 of the Annotated Code of Maryland (1957 Edition), title
"Department of Labor and Industry," subtitle "Occupational
Safety," providing for an increase in both the minimum and maxi-
mum fine and an increase in both the minimum and maximum
term of imprisonment for any violations of the said subtitle, and
providing for a higher minimum fine and minimum term of im-
prisonment if death occurs as a result of a violation.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 43 (a) of Article 89 of the Annotated Code of Mary-
land (1957 Edition), title "Department of Labor and Industry,"
subtitle "Occupational Safety," be and it is hereby repealed and re-
enacted, with amendments, to read as follows:

43. Penalties and injunctions.

(a) Fine and imprisonment. Any person failing to comply with
any provisions of this subtitle or with any rule, regulation, or order
issued thereunder, or interfering with, impeding or obstructing in
any manner the Commissioner of Labor and Industry or his au-
thorized representatives or the Board members in the performance of
their official duties under this subtitle, shall be guilty of a violation
of this subtitle, and upon conviction thereof shall be subject to a
fine of not less than [ten dollars] one hundred dollars nor more than
[one hundred dollars] five thousand dollars or to imprisonment for
not less than [ten] sixty days nor more than [six months] five years,
or both such fine and imprisonment, for each such offense; except

that in the event that death to any individual occurs as a result of a

violation of this subtitle, then the minimum fine shall be one thou-

sand dollars and the minimum term of imprisonment shall be one year.

The violation OFFENSE created under this section shall be in addi-
tion to, and not in substitution for, any existing crimes or offenses,
common law or statutory, now in force in this State.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 267
(House Bill 170)

AN ACT to repeal and re-enact, with amendments, Section 2(a) (64)
of Article 66½ of the Annotated Code of Maryland (1957
Edition), title "Motor Vehicles," subtitle "In General," to include
transportation of motor vehicles to places of business for repair,
painting or remodeling within the definition of the phrase "trans-
porter" under the motor vehicle laws.
