CHAPTER 263
(House Bill 139)
AN ACT to add new Section 12A to Article 27 of the Annotated Code
of Maryland (1957 Edition), title "Crimes and Punishments," sub-
title "Crimes and Punishments," to follow immediately after Sec-
tion 12 thereof and to be under the subheading "Assault—Third
Person Aiding One Being Assaulted," to make it lawful for a
person witnessing an assault to aid the person being assaulted and
designating the degree of force which the volunteer may assert.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 12A be and it is hereby added to Article 27 of the
Annotated Code of Maryland (1957 Edition), title "Crimes and Pun-
ishments," subtitle "Crimes and Punishments," to follow immediately
after Section 12 thereof and to be under the subheading "Assault—
Third Person Aiding One Being Assaulted," and to read as follows:
12A.
Any person witnessing a violent assault upon the person of another
may lawfully aid the person being assaulted by assisting in that
person's defense to such a degree that the combined and total . THE
force exerted upon the attacker or attackers BY THE PERSON
WITNESSING THE ASSAULT MAY be that degree of force which
the assaulted person is allowed to assert in defending himself.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

AN ACT to repeal and re-enact, with amendments, Section 255 (p) of
Article 93 of the Annotated Code of Maryland (1964 Replacement
Volume), title Testamentary Law," subtitle "Orphans' Court," pro-
viding for increases in the salary and the pension allowance for
judges of the Orphans' Court of Baltimore City, and relating
generally to the amount, terms, and conditions for the payment
of salaries and pensions to the judges of the Orphans' Court of
Baltimore City.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 255 (p) of Article 93 of the Annotated Code of Maryland
(1964 Replacement Volume), title "Testamentary Law," subtitle
"Orphans' Court," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
255.
(p) The salary of each of the associate judges of the Orphans'
Court of Baltimore City shall be [nine thousand dollars ($9,000.00)]
