Sec. 2. And be it further enacted, That if any person shall wilfully
and knowingly file any affidavit, make any written or oral statement,
public or private or issue any charge through any media of com-
munications falsely accusing any public official of guilt in any of the
foregoing provisions of this section, such person is punishable by
imprisonment for not more than two (2) years, or by a fine of not
more than one thousand dollars ($1,000.00), or by both.
SEC. 2. AND BE IT FURTHER ENACTED, THAT IF ANY
PERSON SHALL MALICIOUSLY FILE ANY AFFIDAVIT, MAKE
ANY PUBLIC WRITTEN OR ORAL STATEMENT, OR ISSUE
ANY CHARGE THROUGH ANY PUBLIC MEDIA OF COMMUNI-
CATIONS ACCUSING ANY MEMBER OF GUILT IN ANY OF
THE FOREGOING PROVISIONS OF THIS SECTION, HAVING
KNOWLEDGE OF THEIR FALSITY OR WITH RECKLESS DIS-
REGARD OF WHETHER THEY ARE TRUE OR FALSE, SUCH
PERSON IS PUNISHABLE BY IMPRISONMENT FOR NOT
MORE THAN TWO (2) YEARS, OR BY A FINE OF NOT MORE
THAN ONE THOUSAND DOLLARS ($1,000.00), OR BY BOTH.
SEC. 3. AND BE IT FURTHER ENACTED, THAT THE LAWS
ESTABLISHING THE MARYLAND NATIONAL CAPITAL PARK
AND PLANNING COMMISSION AND THE WASHINGTON
SUBURBAN SANITARY COMMISSION BE AMENDED TO THE
EXTENT NECESSARY THAT THE PROVISIONS OF THIS SUB-
TITLE SHALL APPLY TO THE PRINCE GEORGE'S COUNTY
MEMBERS OF SAID COMMISSIONS APPOINTED BY THE
GOVERNOR.
Sec. 3 4. And be it further enacted, That the State's Attorney of
Prince George's County shall enforce the provisions of this subtitle in
accordance with Section 72-2 of the Code of Public Local Laws of
Prince George's County (1963 Edition, being Article 17 of the Code
of Public Local Laws of Maryland), title "Prince George's County,"
subtitle "State's Attorney" , and, further, the State's Attorney shall
employ such staff and use such facilities as shall be necessary to
effectively carry out the provisions and applications of this subtitle.
Sec. 4 5. And be it further enacted, That if any provision of this
subtitle or the application thereof to any person or circumstance is
held invalid for any reason, such invalidity shall not affect the other
provisions or any other application of this subtitle which can be given
effect without the invalid provision or application, and to this end
the provisions of this subtitle are hereby declared to be severable.
Sec. 5 6. And be it further enacted, That this Act shall take effect
June 1, 1965.
