the materials encountered in drilling the well shall be preserved and
submitted to said Department. Upon the completion of the drilling of
any well or wells, a final report shall be filed by the driller with said
Department, giving the log of each well, the size and depth thereof,
the diameters and lengths of casing and screen installed therein, [and
in the case of water wells] the static and pumping levels and the
yield of the well, and such other information pertaining to the con-
struction or operation of the well as said Department by its rules
and regulations may require.

A licensed well driller shall not undertake any operations on the
drilling, boring, coring, digging or construction of a [water] well for
any owner who is required to obtain a permit for the production and
appropriation of waters from said well under Section 11 of this article
until said owner shall have obtained such permit from the Depart-
ment but a permit shall not be refused for domestic use on a farm.
For the purpose of this subtitle, the following words and phrases
are herewith defined:
A "well" is any excavation whether drilled, bored, cored, or dug,
for water, [gas, or oil,] or in exploration for water [, gas, or oil].
Drive point wells and hand dug wells are excluded from the provisions
of this subtitle.
A "well driller" is a person in responsible charge of the actual
drilling, boring, coring, or digging, or construction, alteration or re-
pair of any well.
An "owner" is a person who has the right to drill into and produce
and appropriate the production of water [, gas, or oil], either for
himself or for himself and another or others, and for others.
A "person" means any natural person, corporation, association,
partnership, receiver, trustee, guardian, executor, administrator,
fiduciary, or representative of any kind.
"Underground water" means any supply of water which may be
developed by any type of well or spring from beneath the surface of
the ground whether the water flows therefrom by natural force or is
withdrawn by pumping or other mechanical device or artificial
process.
"Acquifer" means any formation of soil, sand, rock, gravel, lime-
stone, sandstone, or other material, or any crevice from which under-
ground water is or may be produced.
Sec. 2. And be it further enacted. That all laws or parts of laws,
public general or public local, inconsistent with the provisions of this
Act are hereby repealed to the extent of any such inconsistency.
Sec. 3. And be it further enacted. That this Act shall take effect
June 1, 1965.
