and mandatory retirement at age 60; to amend the allowance for
service retirement; to permit ordinary disability retirement after
five years of creditable service; to amend the ordinary disability
retirement allowance; to increase the pension payable upon special
disability retirement and to provide a pension to widows and chil-
dren upon death after special disability retirement; to provide for
revised rates of contribution by members; to provide for benefits
to qualified survivors upon death after service or ordinary disability
retirement, and to provide for a vested retirement allowance upon

separation from service after twenty years of creditable service,

and generally revising the laws applicable to the State Police Re-
tirement System and Department of Maryland State Police.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 49 (15), 53 (1), (2), (3), (4), (6), (7) (a), and (7) (c),
and 56 (1) (a), (1) (b) and (1) (e) of Article 88B of the Annotated
Code of Maryland (1957 Edition and 1964 Supplement), title "State
Police," subtitle "State Police Retirement System" be and they are
hereby repealed and re-enacted, with amendments, to read as follows:

49.

(15) "AVERAGE FINAL COMPENSATION" SHALL MEAN
THE AVERAGE ANNUAL EARNABLE COMPENSATION OF
AN EMPLOYEE DURING THE FIVE CONSECUTIVE YEARS
OF SERVICE AS AN EMPLOYEE, DURING WHICH HIS EARN-
ABLE COMPENSATION WAS HIGHEST OR IF HE HAD LESS
THAN FIVE YEARS OF SERVICE, THEN HIS AVERAGE
EARNABLE COMPENSATION FOR HIS TOTAL SERVICE;
PROVIDED, HOWEVER, THAT DURING THE FIVE-YEAR
PERIOD IMMEDIATELY FOLLOWING THE EFFECTIVE DATE
OF THIS ACT "AVERAGE FINAL COMPENSATION" WILL BE
SUPPLEMENTED BY A SUM EQUAL TO 1/60 OF $1600 MULTI-
PLIED BY THE NUMBER OF MONTHS REMAINING IN THE
FIVE-YEAR PERIOD SUBSEQUENT TO THE EFFECTIVE
DATE OF RETIREMENT.

53.

(1) (a) Any member in service may retire upon written applica-
tion to the Board of Trustees setting forth at what time, not less than
thirty days nor more than ninety days subsequent to the execution
and filing thereof, he desires to be retired, provided that such member
at the time so specified for his retirement shall have attained the
age of 50 [fifty-five] and notwithstanding that during such period
of notification he may have separated from service, excepting the
physician of the Department who shall have attained the age of 65
at the time specified for his retirement.

(b) The Superintendent of Maryland State Police is authorized,
subject to the approval of the Board of Trustees, to order any member
in service who shall have attained the age of 50 [fifty-five] to retire
on the first day of the next calendar month after which such member
shall be notified of the Superintendent's order, provided, that said
Board, before giving its approval as aforesaid, shall first give at least
10 days notice to the member concerned and afford him an oppor-
tunity to be heard.
