CHAPTER 41
(Senate Bill 200)

AN ACT to repeal and re-enact, with amendments, Section 702(o)
of Article 66C of the Annotated Code of Maryland (1957 Edition),
title "Natural Resources", sub-title "Oysters and Clams", amend-
ing the laws concerning the dredging of oysters in the Chesapeake
Bay with particular relation to sailing boats over any areas which
are exempt from dredging, and providing for the circumstances
under which such a boat may be apprehended.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 702(o) of Article 66C of the Annotated Code of Mary-
land (1957 Edition), title "Natural Resources", sub-title "Oysters
and Clams", be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

702.

(o) [It shall be unlawful to sail any] Any boat sailing over any
areas of this State which are exempt from dredging, either by this
sub-title or by any regulations of the Department of Tidewater
Fisheries, with any dredge, scrape, scoop or similar instrument on
board or in tow, [and any officer of the Department, who shall see
any such boat sailing over such area with any of such equipment or
paraphernalia aboard, shall apprehend such boat,] may be appre-
hended by an officer of the Department of Tidewater Fisheries,
and
if the boat shall have on board any wet oysters, dredge or dredge
line, or if the deck be wet and the boat be equipped for taking or
catching oysters with dredge or similar instrument, such fact or
facts shall be prima facie evidence that said boat has been used in
violating the provisions of this section.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1964.

CHAPTER 42
(Senate Bill 12)

AN ACT to add new Section 69A to Article 33 of the Annotated
Code of Maryland (1957 Edition), title "Elections", subtitle "Cer-
tificates of Nomination", to follow immediately after Section 69
thereof, to prohibit the printing on general election ballots for a
particular office of the names of defeated candidates for that
office at the previous primary election, providing for certain ex-
ceptions, and relating to elections in the State.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 69A be and it is hereby added to Article 33 of the
Annotated Code of Maryland (1957 Edition), title "Elections", sub-
