79.

(a)  For the purposes of this subtitle,

(b)  The term "employer" does not include a club exclusively social,
or a fraternal, charitable, educational or religious association or
corporation, if the club, association or corporation is not organized
for private profit,
OR ANY PERSON, COMPANY OR CORPORA-
TION ENGAGED IN INTERSTATE TRANSPORTATION WHOSE
EMPLOYMENT PRACTICES ARE REGULATED BY FEDERAL
STATUTE OR REGULATION.

(c)  The term "employment agency" includes any person, firm or
corporation undertaking to procure employees, or opportunties to
work.

(d)  The term "age" applies as to any person who is forty years
of age or over and not more them sixty-five years of age. However,
the use of the term "age" in this subtitle is not (1) to prevent the
termination of the employment of any person who is physically
unable to perform his duties, or (2) to affect the retirement policy
or system of any employer if such policy or system is not merely a
subterfuge to evade the purposes of this subtitle, or (3) to preclude
the varying of insurance coverages according to an employee's age.

80. The provisions of this subtitle shall be enforced and admini-
tered by the Department of Employment Security with the assistance
of the Attorney General of Maryland.
NO GENERAL PENALTY
PROVISION CONTAINED IN THIS ARTICLE SHALL APPLY
TO THE PROVISIONS OF THIS SUBTITLE.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1964.

CHAPTER 187
(House Bill 46)

An Act to repeal Section 115A of Article 66½ of the Annotated Code
of Maryland (1963 Supplement), title "Motor Vehicles," subtitle
"Civil Liability"; to add new Section 167A to the said Article of
the Code (1957 Edition), subtitle "Unsatisfied Claim and Judg-
ment Fund," to follow immediately after Section 167 thereof; and
to repeal and re-enact, with amendments, Section 173 of the said
Article and subtitle of the Code, to repeal provisions for service
of process against uninsured motorists who cannot be located,
to establish a procedure for the bringing of claims against unin-
sured motorists under the Unsatisfied Claim and Judgment Fund
whose identity is known but who cannot be located for service of
process, providing for subrogation by the Commissioner of Motor
Vehicles against uninsured motorists who cannot be located, and
relating to the filing of claims against uninsured motorists and
service of process under the Fund law.
