importation of any shellfish from any source outside of the State of
Maryland, and to quarantine any area within the State of Maryland
populated by shellfish infected or affected or suspected of being
infected or affected by any of the conditions enumerated herein, and
to establish by such rules and regulations the penalties for the
violation of any one or more of such rules and regulations. No such
penalty shall exceed a fine of one thousand dollars ($1,000.00), or
imprisonment for a period of one year, or both fine and imprisonment,
together with the confiscation, in addition to such fine or imprison-
ment, or both, of all gear and equipment, whether afloat or ashore,
used in perpetrating the violation or violations, all in the discretion
of the court.
13E. (a) The Department shall have charge of the inspection of
fish, crabs, terrapin, oysters, clams and other aquatic resources
wherever caught or sold in the State of Maryland and of the enforce-
ment of the cull laws and other protective measures. Nothing in this
section is intended in any way to interfere with any inspections made
by the State Department of Health.
(b) It shall be the duty of the Department, through its auditor,
inspectors or other employees, to audit the books of the various
persons, firms and corporations packing or dealing in resources
within the jurisdiction of the Department including any takers of
the same who may ship directly to market, for the purpose of deter-
mining quantities taken and such other data as may be needed for
reporting and accounting to the appropriate State officials.
13F. Any person, firm or corporation buying or selling oyster
shells shall report to the Department, at such times as the Department
may prescribe, each purchase or sale of oyster shells, stating the
number of bushels purchased or sold, the date of sale, the name and
address of the other party to the transaction, and such other informa-
tion as the Department may prescribe.
13G. Every person, firm or corporation engaged in the business
of packing or dealing in any of the resources within the jurisdiction
of the Department shall keep accurate books, statements and ac-
counts showing all the details of said business; and all such books,
statements and, accounts shall be open to inspection at all reasonable
hours, by the duly authorized agents of the Department. Every per-
son, firm or corporation engaged in the business of packing or dealing
in any of the resources within the jurisdiction of the Department and
every person licensed by the Department to take or catch the same,
shall make such reports as may be required from time to time by the
Department, on forms prescribed by it.
13H. Any person aggrieved by a final decision of the Department,
whether such decision is affirmative or negative in form, or by any
rule or regulation of the Department, may file a sworn petition with
the Commission, asking for a hearing on the decision, or rule or
regulation. The petition shall set forth the grounds and reasons for
the petitioner's complaint. The Chairman shall set a time and place
for the hearing and shall notify the petitioner. At the hearing, the
petitioner and any other interested parties may appear in person
or by counsel, present witnesses and submit evidence. The Chairman
or any member of the Commission shall have the power to administer
