12. The Department shall be responsible for the planning, develop-
ment and management of the Chesapeake Bay and all other tidal
waters, including the shorelines and bottoms thereof, and all re-
sources associated therewith, excluding any matters under the juris-
diction of the Maryland Geological Survey, the Department of Game
and Inland Fish, the Department of Water Resources, and the De-
partment of Forests and Parks. In addition to the powers conferred
upon the Department of Tidewater Fisheries prior to June 1, 1964,
herein transferred to the Department, it also shall have the follow-
ing powers: planning and development of recreational facilities in or
on the waters of the Chesapeake Bay and other tidal waters and the
assistance of other agencies in the planning of public recreational
facilities associated with the Chesapeake Bay and other tidal waters;
cooperation with other agencies in carrying out measures for the
protection of tidal waterfront and waterways of the State against
erosion and deposition; conduct of demonstrations of extended dura-
tion for the purpose of improving the fisheries or for such other
needs as may be necessary in carrying out its duties herein; acting
for the State in the further development of navigational aids and
improvement of waterways in the Chesapeake Bay and other tidal
water areas of the State.
13. (a) The Department shall have general supervisory power,
regulation and control over the natural resources of the State within
the bounds of tidal waters.
(b) The Department shall exercise the powers conferred and per-
form the duties imposed by all laws now in force or thereafter en-
acted relating to the natural resources of the State within the bounds
of tidal waters.
(c) The Department is authorized to operate, sell, buy, lease, ex-
change, rent, or repair such vehicles, vessels, boats, nets and other
equipment as may be necessary for its work, and to provide such
arms, ammunition, and equipment as may be required for vehicles,
vessels, boats owned by it or owned, by the State of Maryland and
operated by it, subject to the provisions of Article 15A of this Code,
title "Budget and Procurement."
(d) The Department is authorized to contract for research or
scientific investigation with the Natural Resources Institute of the
University of Maryland, the Chesapeake Bay Institute of the Johns
Hopkins University or other appropriate research organizations.
13A. (a) The Department shall have the following additional
powers:
(b) To issue a new license for commercial fishing in place of each
license that is forfeited.
(c) To issue licenses and establish fees for all nonresident buyers
of seafood, seafood in wholesale or bulk quantities, when the pur-
chase is from a buy boat or from a truck or other vehicle. Any such
fee shall not exceed the sum of fifty dollars ($50.00) annually.
(d) To negotiate under existing law with other states for agree-
ments on the catching of crabs, the sizes of fish, and opening and
closing of seasons.
