have knowledge and experience in the administration of parks, for-
ests and recreation areas.

(B) IT IS THE INTENTION OF THE GENERAL ASSEMBLY
THAT THE DIRECTOR OF THE DEPARTMENT SHALL BE A
PERSON OF ACTUAL, PROVEN ADMINISTRATIVE AND
EXECUTIVE ABILITY AND THAT IN ADDITION THE DI-
RECTOR SHALL POSSESS PROFESSIONAL KNOWLEDGE
AND TRAINING IN FORESTRY OR IN PARKS AND RECREA-
TION, OR IN BOTH FORESTRY AND PARKS AND RECREA-
TION. IN FILLING THE POSITION OF DIRECTOR, THE
GOVERNOR SHALL RECEIVE AND CONSIDER ALL APPLICA-
TIONS FROM ANY PERSONS INCLUDING PRESENT EM-
PLOYEES OF THE DEPARTMENT WHO ARE ABLE TO MEET
THE REQUIREMENTS SET OUT HEREIN FOR THE POSITION
OF DIRECTOR.

(c)  Before assuming the duties of his office, the Director is re-
quired to take the constitutional oath of office.

(d)  The Director is in sole and active charge of the Department,
subject only to his responsibility to the Governor.

344A.

There shall be two divisions within the Department, a Division
of Forests, under the direction of the State Forester, and a Division
of State Parks, under the direction of the Superintendent of State
Parks. The State Forester and the Superintendent of State Parks
shall be appointed by the Director of the Department for indefinite

terms and shall hold their positions subject to IN ACCORDANCE

WITH the provisions of the State merit system IN ARTICLE 64A OF
THIS CODE. The State Forester shall have special training
and experience in forestry and shall be a graduate of an accredited
school of forestry. He shall have charge of all forests in the State
subject to the direction of the Director of the Department. The
Superintendent of State Parks shall have special training and ex-
perience in parks and recreation. He shall have charge of all parks
and recreational areas in the State subject to the direction of the
Director of the Department. The State Forester and the Superin-
tendent of State Parks shall receive such salaries as shall be pro-
vided in the annual State budget.

SEC. 2. AND BE IT FURTHER ENACTED, THAT THE PER-
SONS WHO HELD THE POSITIONS OF STATE FORESTER V
AND PARK SUPERINTENDENT V IMMEDIATELY PRIOR TO
JUNE 1, 1964, IF THEY RESPECTIVELY THEN HAD HELD
THESE POSITIONS FOR NOT LESS THAN THE SIX MONTHS
IMMEDIATELY PRECEDING, SHALL BE RESPECTIVELY THE
STATE FORESTER AND THE SUPERINTENDENT OF STATE
PARKS, AS THESE POSITIONS ARE ESTABLISHED IN THIS
ACT. EACH SHALL BE IN THE RESPECTIVE POSITION
WITHOUT EXAMINATION AND WITH NO DIMINUTION OF
SALARY OR OF ANY OF THE RIGHTS AND PRIVILEGES
PROVIDED UNDER ARTICLE 64A OF THIS CODE.

Sec. 2 3. And be it further enacted, That this Act shall take
effect June 1, 1964.
