Sec. 3. And be it further enacted, That not later than August
31, 1964, the State Fire Prevention Commission shall appoint a State
Fire Marshal, who shall begin his duties on September 1, at which
time the State Fire Prevention Code shall become effective. Until
August 31, 1964, the Insurance Commissioner shall continue to exer-
cise the powers of the State Fire Marshal, as they existed prior to the
passage of this Act, and as if this Act had not been enacted.

Sec. 4. And be it further enacted, That the office furniture
and equipment, books, records, and accounts and all personal prop-
erty of the State Insurance Commissioner used in his capacity as
ex-officio Fire Marshal and also all credits and appropriations on
the books and accounts of this State to the State Insurance Commis-
sioner in his capacity as ex-officio Fire Marshal are transferred to
and shall be in the custody of the State Fire Prevention Commission
and the State Fire Marshal herein created. All references in the laws,
ordinances, resolutions and regulations of this State and of any politi-
cal subdivision of this State to the State Insurance Commissioner in
his capacity as ex-officio State Fire Marshal henceforth shall be
references to the State Fire Prevention Commission or the State
Fire Marshal herein created, as the case may be.

Sec. 5. And be it further enacted, That this Act shall take
effect July 1, 1964.

CHAPTER 47
(Senate Bill 29)

AN ACT to add new Section 62 to Article 88A of the Annotated Code
of Maryland (1957 Edition), title "State Department of Public
Welfare," subtitle "Prohibited Acts," to follow immediately after
Section 61 thereof, requiring every person who in any manner
applies for money or other assistance under a public welfare pro-
gram to do so in writing and to sign the application and provide
that false or fraudulent statements in such an application are per-
jury and punishable as such.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 62 be and it is hereby added to Article 88A of the
Annotated Code of Maryland (1957 Edition), title "State Depart-
ment of Public Welfare", subtitle "Prohibited Acts", to follow im-
mediately after Section 61 thereof, and to read as follows:

62.

Every application for monies or other assistance under any public
welfare program, whether under this or any other Article in this
Code, shall be in writing and signed by the applicant. Any person
who in making and signing such an application makes a false or
fraudulent statement with intent to obtain any assistance which as to
that person is unjustified, excessive, or fraudulent, is guilty of per-
