CHAPTER 55
(Senate Bill 21)
AN ACT to repeal and re-enact with amendments, Section 112 (2)
of Article 77 of the Annotated Code of Maryland (1962 Supple-
ment), title "Public Education," sub-title "Chapter 8. Teachers*
Certificates, Salaries and Pensions", sub-heading "Teachers' Re-
tirement System", amending the laws concerning the Teachers'
Retirement System of the State of Maryland in order to conform
with the Militia Law of Maryland.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 112 (2) of Article 77 of the Annotated Code of Mary-
land (1962 Supplement), title "Public Education" sub-title "Chapter
8. Teachers' Certificates, Salaries and Pensions", sub-heading "Teach-
ers' Retirement System" be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

(2) Determination of "one year service"; Military Service.—The
Board of Trustees shall fix and determine by appropriate rules and
regulations how much service in any year is equivalent to one year
of service, but except as otherwise provided, in no case shall more
than one year of service be creditable for all service in one calendar
year. The Board of Trustees, under such rules and regulations as
it shall adopt, shall allow credit, however, to members absent in the
military service during World War I or within the [period beginning
September 1, 1940, and ending December 31, 1945, or within the
period beginning June 1, 1950, and ending June 1, 1959] periods
and under the provisions specified in Section 88 of Article 65 of the
Annotated Code of Maryland (1957 Edition as amended), for the
period of their absence, provided that such members were teachers
when they entered such military service and who again became
teachers. However, any teacher whose Board of Education had
granted him a leave of absence immediately before he left for
military service shall be considered to have left the teaching profes-
sion for military service. Service rendered for the regular school
year in any district shall be equivalent to one year's service.
Sec. 2. And be it further enacted, That this act shall take effect
July 1, 1963.
