Section 14.

For the purposes of this Article, property shall be deemed to have
been taken:

1.  In cases in which the plaintiff is lawfully authorized to take
the property before trial pursuant to Section 40A or Section 40B of
Article III of the Constitution of this State, when the payment re-
quired thereunder has been made to the defendant or into court and
any security required thereunder has been given and there has been
an actual and lawful appropriation of the property to the public pur-
poses of the plaintiff.
THE PLAINTIFF HAS TAKEN POSSESSION
OF THE PROPERTY AND ACTUALLY AND LAWFULLY AP-
PROPRIATED IT TO THE PUBLIC PURPOSES OF THE PLAIN-
TIFF.

2.  In all other cases, upon payment of the judgment and costs
by the plaintiff pursuant to Maryland Rule U23.
SUBTITLE U OF
THE MARYLAND RULES.

SEC. 2. AND BE IT FURTHER ENACTED, THAT IF ANY
PROVISION OF THIS ACT OR THE APPLICATION THEREOF
TO ANY PERSON OR CIRCUMSTANCES IS HELD INVALID,
SUCH INVALIDITY SHALL NOT AFFECT THE OTHER PRO-
VISIONS OR ANY OTHER APPLICATION OF THIS ACT WHICH
CAN BE GIVEN EFFECT WITHOUT THE INVALID PROVISION
OR APPLICATION, AND TO THIS END THE PROVISIONS OF
THIS ACT ARE HEREBY DECLARED TO BE SEVERABLE.

SEC. 3. AND BE IT FURTHER ENACTED, THAT ALL LAWS
OR PARTS OF LAWS, PUBLIC GENERAL OR PUBLIC LOCAL,
INCONSISTENT WITH THE PROVISIONS OF THIS ACT ARE
HEREBY REPEALED TO THE EXTENT OF ANY SUCH IN-
CONSISTENCY.

Sec. 2. 4. And be it further enacted, That this Act shall take effect
June 1, 1963.

CHAPTER 53
(Senate Bill 12)

An Act to repeal and re-enact, with amendments, Section 49 of
Article 16 of the Annotated Code of Maryland (1962 Supplement),
title "Chancery," subtitle "Inebriates," to require a judge before
committing a person habitually addicted to the use of narcotic
drugs to a state mental hospital to consult with and have the
approval of the superintendent of the hospital for the commitment.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 49 of Article 16 of the Annotated Code of Maryland
(1962 Supplement), title "Chancery," subtitle "Inebriates," be and
it is hereby repealed and re-enacted, with amendments, to read as
follows:
