Planning Commission and relating generally to the procedures and
the requirements for approval.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 161 of the Code of Public Local Laws of Howard County
(1957 Edition, being Article 14 of the Code of Public Local Laws of
Maryland), title "Howard County," subtitle "Planning and Subdivi-
sion Control," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
161.
(a) Whenever the Commission shall have adopted the master plan
of the County or of one or more major sections or districts thereof,
no street, square, park or other public way, ground, or open space,
or public building or structure, or public utility, whether publicly
or privately owned, shall be constructed or authorized in the County,
or in such planned section and district, until the location, character,
and extent thereof shall have been submitted to and approved by the
Commission; provided, that in case of disapproval the Commission
shall communicate its reason to the County Commissioners, who shall
have the power to overrule such disapproval by a recorded vote of not
less than two-thirds of its entire membership.
(b) The Planning Commission shall have power and authority to
make such investigations, maps, reports and recommendations in
connection therewith, relating to the planning and physical develop-
ment of the County, as it deems desirable. The Planning Commission
shall annually prepare a six-year capital improvement program for
streets, highways, water and sewer facilities, storm drains, buildings,
parks, playgrounds, schools and other public facilities and structures.
The six-year capital improvement program shall consist of an annual
capital budget and a five-year capital improvement program, which
is a long-range list of proposed capital projects. The Planning Com-
mission may use the facilities of all County departments for the col-
lection of data and shall receive the recommendations from all County
Departments on or before September 1st of each year NOT LATER
THAN FOUR MONTHS PRIOR TO THE BEGINNING OF EACH
FISCAL YEAR concerning their capital improvement needs before
the six-year capital improvement program is prepared. The Plan-
ning Commission shall consult with the heads of all County depart-
ments before final action is taken on the six-year capital improve-
ment program. The six-year capital improvement program, after
approval by the Planning Commission, shall be submitted to the
County Commissioners not later than October 1st of each year
THREE MONTHS PRIOR TO THE BEGINNING OF EACH FIS-
CAL YEAR. The Planning Commission shall also submit not later
than October 1st of each year THREE MONTHS PRIOR TO THE
BEGINNING OF EACH FISCAL YEAR, recommendations for the
annual capital budget for the following year to the County Com-
missioners.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.
