Physicians" and "Chapter 27. Free Scholarships"; to repeal Sec-
tions 164 to 170, inclusive of said Article 77 of the Code, title,
"Public Education," being subtitle "Chapter 13. State Teachers
Colleges"; to add new Sections 164 and 165 to said Article 77 of
the Code to follow immediately after Section 163 thereof and to
be under the new subtitle "Chapter 13. State Colleges," in lieu
of the Article and Sections so repealed; and to repeal and re-enact,
with amendments, Sections 26, 33, 42, 46, 215(b) and 244 of said
Article 77 of the Code (1957 Edition and 1962 Supplement), sub-
titles, respectively, "Chapter 3. State Board of Education," "Chap-
ter 4. State Superintendent of Schools," "Chapter 20. Source and
Distribution of Income" and "Chapter 25. Miscellaneous"; AND
TO ADD NEW SECTIONS 325 to 328, INCLUSIVE, TO SAID
ARTICLE 77 OF THE CODE TO FOLLOW IMMEDIATELY
AFTER SECTION 324 THEREOF AND TO BE UNDER THE
NEW SUBTITLE "CHAPTER 35. ADVISORY COUNCIL FOR
HIGHER EDUCATION"; relating generally to higher education
in the State of Maryland, creating a Board of Trustees of the
State Colleges to supervise and control the maintenance and
operation of the public colleges of the State, prescribing the organi-
zation, functions, powers and duties of said Board, and providing
for an assistant state superintendent of schools to supervise a
division of higher education in the Department of Education and
to otherwise carry out the responsibilities of the State Board of
Education and the State Superintendent of Schools in the field of
higher education. PROVIDING BY A FURTHER AMEND-
MENT TO SAID NEW SECTION 164 (A) FOR THE INCLU-
SION OF MORGAN STATE COLLEGE WITHIN THE JURIS-
DICTION OF SAID BOARD UPON THE HAPPENING OF A
CERTAIN CONTINGENCY, CREATING AN ADVISORY
COUNCIL FOR HIGHER EDUCATION TO STUDY AND RE-
PORT ON AND MAKE RECOMMENDATIONS WITH RE-
SPECT TO THE CONTINUING AND CHANGING REQUIRE-
MENTS AND FUNCTIONS OF PUBLIC HIGHER EDUCATION
IN THE STATE, TO ADVISE AS TO THE COORDINATION
OF THE OPERATIONS AND PROGRAMS OF THE STATE
INSTITUTIONS OF HIGHER LEARNING, AND PRESCRIBING
THE ORGANIZATION, FUNCTIONS, POWERS AND DUTIES
OF SAID COUNCIL.
Section 1. Be it enacted by the General Assembly of Maryland,
That Article 65A of the Annotated Code of Maryland (1957 Edition,
hereinafter referred to as "the Code"), title "Morgan State Col-
lege," be and it is hereby repealed; THE SAME SHALL STAND
REPEALED AS OF THE FIRST DAY OF JULY NEXT FOLLOW-
ING THE RECOGNITION BY THE ACCREDITING AGENCY
OF THE ACCREDITED STATUS OF ANY THREE COLLEGES
UNDER THE GOVERNMENT OF THE BOARD OF TRUSTEES
OF THE STATE COLLEGES, AFTER SUCH COLLEGES, HAV-
ING INSTITUTED OR CONTINUED BACCALAUREATE DE-
GREE PROGRAMS IN THE ARTS AND SCIENCES AS DI-
RECTED BY THIS ACT, SHALL HAVE VALIDATED THE AC-
CEPTABILITY OF SUCH PROGRAMS TO THE SATISFACTION
OF SAID ACCREDITING AGENCY. "ACCREDITING AGENCY"
MEANS THE COMMISSION ON INSTITUTIONS OF HIGHER
EDUCATION OF THE MIDDLE STATES ASSOCIATION OF
