tion in fact discriminates against a Maryland license or permit
holder, then the Comptroller shall impose on the seller a similar or
like tax, assessment, impost or other charge or restriction for the
privilege of soliciting sales of alcoholic beverages and/or consigning
alcoholic beverages from such jurisdiction to persons in the State of
Maryland. Provided, however, the retaliatory provisions of this sec-
tion affecting distillers shall not apply to any person who has a dis-
tillery plant in any other state or states, if such person has a dis-
tillery plant in this State.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

(Senate Bill 283)
AN ACT to repeal and re-enact, with amendments, Section 78 of
Article 2B of the Annotated Code of Maryland (1957 Edition),
title "Alcoholic Beverages", sub-title "Rights and Duties of Licen-
sees", providing that Class G licenses shall be included among
those licenses which shall not expire or become inoperative because
of the death and/or incompetence of one or more, but less than
all, of the persons to whom it is issued for a company.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 78 of Article 2B of the Annotated Code of Maryland
(1957 Edition), title "Alcoholic Beverages", sub-title "Rights and
Duties of Licensees", be and the same is hereby repealed and re-
enacted, with amendments, to read as follows:
78.
Upon the death of the holder of any license issued under the pro-
visions of this article other than Class E [and], Class F and Class G
licenses, the license shall expire, except as herein otherwise provided,
provided, however, that upon application to the Comptroller, or the
clerk of the court issuing such license, as the case may be, and upon
the payment of a fee of one dollar ($1.00), made by the executors
or administrators of the deceased licensee, a certificate of permis-
sion may be granted for the continuation of the business in the
name of such executors or administrators for the benefit of the
estate of the deceased for a period not exceeding eight months from
the date of any such permission, unless the license shall sooner
expire, in which case upon application by the executor or adminis-
trator as above provided a renewal license for a period not exceed-
ing [8] eight months after the death of the license holder may be
issued subject to the right of protest, revocation, suspension and
restriction as in other cases, upon the payment of a pro rata license
fee for such period, and during the period of such continuation the
said license and the executors or administrators of the deceased
shall be subject to all of the provisions of this article. The said
administrator or executor to which the aforesaid certificate of per-
mission has been granted may assign or transfer said license for the
