CHAPTER 14
(Senate Bill 35)

AN ACT to repeal and re-enact, with amendments, Section 12 of
Article 75A of the Annotated Code of Maryland (1962 Supple-
ment) , title "Public Accountancy", correcting an error in the law
relating to administrative proceedings involving the public ac-
countancy law.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 12 of Article 75A of the Annotated Code of Maryland
(1962 Supplement), title "Public Accountancy", be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

The Board may initiate proceedings under this article either on
its own motion or on the complaint of any person. Such proceedings
shall be conducted according to regulations established by the Board
as to notice, hearing, representation by counsel, and procedure. The
Board or any member thereof may issue subpoenas to compel the
attendance of witnesses and the production of documents, and may
administer oaths, take testimony, and receive exhibits in evidence.
In case of disobedience to a subpoena the Board may invoke the aid
of any court of this State in requiring the attendance and testimony
of witnesses and the production of documentary evidence. The Board
shall not be bound by technical rules of evidence. The decision of the
Board shall be by majority vote. Anyone adversely affected by such
decision shall be entitled to review thereof as provided by the
[Administration] Administrative Procedure Act, Sections 255 and
256 of Article 41 of this Code as amended from time to time.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

CHAPTER 15
(Senate Bill 41)

AN ACT to repeal and re-enact, with amendments, Section 11 (d)
of Article 90 of the Annotated Code of Maryland (1962 Supple-
ment) , title "Sureties," sub-title "Contract Performance and Pay-
ment Bonds," to permit suits by subcontractors, materialmen and
others under contracts for public work for the State or its political
subdivisions on payment bonds furnished by the contractor of the
project to be brought where the contractor has his place of
business.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 11 (d) of Article 90 of the Annotated Code of Maryland
(1962 Supplement), title "Sureties," sub-title "Contract Performance
