(CHAPTER 95

(Senate Bill 102)

AN ACT to add new Sections 171B and 171C to Article 19 of the
Code of Public Local Laws of Maryland (1930 Edition), title "St.
Mary's County", sub-title "Retirement System", authorizing pay-
ment of certain retirement benefits in the discretion of the St.
Mary's County Commissioners to employees qualifying under the
Act, providing that county retirement benefits now fixed by law
shall not apply to employees after the establishment by the County
Commissioners of a retirement and pension system applicable to
them and generally relating to such systems in St. Mary's County.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 171B and 171C be and they are hereby added to
Article 19 of the Code of Public Local Laws of Maryland (1930
Edition), title "St. Mary's County", sub-title "Retirement System",
to follow immediately after 171A thereof and to read as follows:

171B.

The County Commissioners in their discretion may pay to any
person appointed and employed by or under the authority of the
County Commissioners who has completed fourteen (14) years of
service for the county, who has attained the age of sixty-five (65)
years of age, and who retires from county employment, retirement
benefits in an amount not to exceed $125.00 per month. Such bene-
fits shall be subject to the same restrictions and payable from the
same source as the benefits provided in Section 171A of this Code.

171C.

The provisions of Sections 171A and 17IB of this Code shall apply
only to employees qualifying thereunder prior to the establishment
by the County Commissioners of any system of retirement and pen-
sion benefits applicable to such employees. The establishment of such
a system shall supercede the provisions of the above sections insofar
as they apply to any person entitled to benefits under the system
established.

Sec. 2. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the imme-
diate preservation of the public health and safety, and having been
passed by a yea and nay vote supported by three-fifths of the mem-
bers elected to each of the two houses of the General Assembly the
same shall take effect from the date of its passage.
