is required by State or local law to attain standards of competency
or experience as a prerequisite to engaging in such craft or profes-
sion, and who is acting exclusively within the scope of the craft or
profession for which he is currently licensed pursuant to such other
law; and the salesman in regard to such a transaction.
(3) Any home improvement, where the aggregate contract price
for all labor, materials and other items is less than $300.00. This
exemption does not apply where the work is only part of a larger or
major operation, whether undertaken by the same or a different
contractor, or in which a division of the operation is made in con-
tracts of amounts less than $300.00 for the purpose of evasion of this
provision or otherwise.
(4) Any retail clerk, clerical or other employee of a licensed con-
tractor, as to a transaction on the premises of the contractor; and any
solicitor for a contractor who makes contact with an owner by tele-
phone only.
[(5) Any contractor or salesman, as to a home-improvement con-
tract where the owner is obligated to pay only upon or after com-
pletion of the home-improvement work, or to pay a part of the con-
sideration only upon or after completion of the portion of such work
to which the payment relates; except where any promissory note,
mortgage, or other instrument to secure payment of the considera-
tion to the contractor is required of the owner or accepted by the
contractor in advance of completion of the work or portion thereof.
(6) Any contractor or salesman, as to the construction, installa-
tion, or repair of swimming pools and parts thereof.]

(f) Temporary licenses may be issued by the executive [secretary]
director, in accordance with such rules or regulations as the Commis-
sion may prescribe, to any applicant for a license who files an applica-
tion in proper form and pays the annual license fee therefor. A
temporary license shall automatically expire at the time the Com-
mission either refuses to issue or grants the license, and shall be
subject to termination by the executive [secretary] director at any
time prior to action by the Commission.

(a) The Commission shall have the power to refuse, suspend or
revoke any licenses issued under the provisions of this subtitle where
the Commission finds that the licensee has violated any provision of
this subtitle [;] or [where the Commission finds that the licensee]
is performing or attempting to perform any [of the following acts,
each of which is prohibited] act prohibited by this subtitle.
(b) Any violation of any of the provisions of this subtitle upon
the part of any director, manager, partner, officer, salesman, agent,
or employee of a contractor shall be cause for suspension or revoca-
tion of the license of the contractor, unless it shall appear to the satis-
faction of the Commission that the individuals engaged in the man-
agement of the contractor (1) had no knowledge of the wrongful
conduct, or (2) were unable to prevent the violation.
