renumber and recodify Sections 247(d), 248, 260, 261, 265 and 268
of said Article and subtitle, said Sections to be henceforth num-
bered within said Article and subtitle as follows: Section 247(d)
to be numbered Section 248, Section 248 to be numbered 268, Sec-
tion 260 to be numbered 262, Section 261 to be numbered 265,
Section 265 to be numbered 266, and Section 268 to be numbered
269; revising, reorganizing and generally relating to the Home-
Improvement Law of this State, designating the executive secretary
of the Home-Improvement Commission as executive director, re-
quiring appointment or employment by a licensed contractor as
a condition to issuance of a salesman's home-improvement license,
extending the licensing requirements of the home-improvement
law, providing sanctions against willful violation of orders of the
Commission and for their enforcement, prescribing grounds for
refusal of home-improvement licenses to applicants, and requiring
in home-improvement contracts inclusion of finance charges and
descriptions of security taken.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 262, 266 and 269 of Article 56 of the Annotated Code
of Maryland (1962 Supplement, hereinafter referred to as "the
Code"), title "Licenses," subtitle "Home-Improvement Law," be and
they are hereby repealed.

Sec. 2. And be it further enacted, That Sections 249(c), 252,
255(b), 256, 257(f), 258, 259, and 261(b), (C) AND (D), of said
Article and subtitle of the Code are hereby repealed and re-enacted,
with amendments, and certain sections thereof renumbered, and that
new Section 258 is hereby added to said Article and subtitle to follow
immediately after Section 257 thereof, and all to read as follows:

249.

(c) "Home improvement" means the repair, replacement, remodel-
ing, alteration, conversion, modernization, improvement, or addition
to any land or building, or that portion thereof which is used or de-
signed to be used as a residence or dwelling place; and shall include
the construction, replacement, or improvement of driveways, swim-
ming pools, porches, garages, landscaping, fences, fallout shelters
and other improvements to structures or upon land which is adjacent
to a dwelling house. "Home improvement" shall not include (i) the
construction of a new home building or work done by a contractor in
compliance with a guarantee of completion of a new building project,
or (ii) the sale of goods or materials by a seller who neither arranges
to perform nor performs directly or indirectly any work or labor in
connection with the installation of or application of the goods or
materials. Without regard to the extent of affixation, "home im-
provement" includes the installation of central heating or air-condi-
tioning systems, storm windows, awnings, or fire alarms.

252.

(a) The Commission shall employ and may discharge at any time
an executive [secretary] director who shall be a full-time employee
of the State. The executive [secretary] director shall:

(1) Take charge of the office of the Commission;
