ery County shall provide for the election of members of the Board
of Education as herein provided. Provisions shall be made for use
of voting machines, or, in the alternative, for the use of paper ballots
under the conditions herein prescribed. The names of all candidates
who have been duly nominated under the provisions of subsection
(b) of Section 12 of this Article for election to the several Board of
Education offices shall, except in the case of death, be placed on the
ballot. The person among the two whose names are placed on the
election ballot as candidates for election to the County Board of Ed-
ucation from each council district who receives the largest number
of votes, and the two persons among the four whose names are placed
on the ballot as candidates for election to the County Board of Edu-
cation at-large who receive the largest number of votes at said elec-
tion, shall be declared elected for the respective Board of Education
offices. All voting for the County Board of Education members, either
in a primary election or in a general election, shall be conducted on
a nonpartisan basis and on a general county-wide ticket; no designa-
tion of party affiliation shall be placed upon any petition for nomi-
nation, nor upon any voting machine or paper ballot used at any said
primary or general election.

[c] (d) Vacancy.—Any vacancy on the said Board in an office
filled by an interim incumbent or an elected member resulting from
death, resignation, failure to qualify, or any other reason shall be
filled by the selection by the remaining members of the Board of a
duly qualified person to fill the vacancy. Any person so selected shall
serve for the unexpired portion of the term of the vacancy or until
his successor is elected and qualified.

[d]  (e) Removal.—The Montgomery County council may remove
any member of the Board elected or serving under the provisions of
this section for immorality, misconduct in office, incompetency, or
wilful neglect of duty, giving to him a copy of the charges against
him, and an opportunity of being publicly heard in person or by
counsel in his own defense, upon not less than ten days notice. If
any member of the Board of Education shall be so removed, he shall
have the right to a review by the Circuit Court for Montgomery
County in a proceeding de novo.

[e]  (f) Compensation.—No member of said Board of Education
shall receive compensation for his services, but shall receive an al-
lowance of $300.00, annually or such larger sum for travel and other
expenses as may be provided by the county council of Montgomery
County.

[f] (g) Powers and duties.—The County Board of Education of
Montgomery County shall perform the functions of county boards of
Education as provided by State law and shall have power to adopt
bylaws for regulation and administration of schools within the coun-
ty not inconsistent with State law; provided, however, that all action
shall be accomplished after a public meeting, the formal record of
which shall likewise be public. Nothing in this section shall be deemed
to deny the power of the Board to meet and deliberate in executive
session provided, however, that all action of the Board together with
the individual vote of each member shall be a matter of formal public
record.
