Section 1. Be it enacted by the General Assembly of Maryland,
That Section 30-2 of the Baltimore County Code, 1958 Edition, title
"Taxicabs," be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
30-2.
In order to protect the public health, safety and welfare of the
citizens of the county and other persons who may use taxicab facilities
therein, the county is hereby authorized and empowered to enact,
amend and repeal ordinances, to fix requirements for the [ownership
and] operation of taxicabs in the county and to provide for inspection
and licensing of [taxicabs, their owners and] operators. The regula-
tion herein provided for the taxicab [industry] operators in the coun-
ty shall be in addition to any regulation by the Commissioner of Motor
Vehicles of Maryland or the Public Service Commission of Maryland.
Nothing in this or the following section shall be construed to permit
the regulation by the county of taxicabs regularly operating in Balti-
more City and operating occasionally in the county; provided, that
the taxicabs are subjected to regulation as to rates and practices by
the Public Service Commission of Maryland and the City of Balti-
more, prior to and at the time of any operation in the county.
Sec. 2. And be it further enacted, That Section 30-2.1 of the Balti-
more County Code (1961 Supplement), title "Taxicabs," be and it is
hereby repealed.
Sec. 3. And be it further enacted, That this Act shall take effect
June 1, 1963. , CONTINGENT UPON THE TAKING EFFECT OF
CHAPTER........, ACTS OF 1963 (BEING HOUSE BILL 355) AND
IN THE EVENT SUCH CHAPTER ........ DOES NOT BECOME
EFFECTIVE, THEN THIS ACT SHALL BE NULL AND VOID
WITHOUT THE NECESSITY OF FURTHER ACTION BY THE
GENERAL ASSEMBLY.

AN ACT to add a new section to the Montgomery County Code (1960
Edition) being Article 16 of the Code of Public Local Laws of
Maryland, title "Montgomery County," subtitle "Chapter 2. Ad-
ministration," subheading "Article XIII. Finance and Taxation
Generally," sub-subheading "Division 4. Taxation Generally,"
said new section to be known as Section 2-125A and to follow imme-
diately after Section 2-125 thereof, providing additional taxing
powers to the County Council of Montgomery County.
