1316                              LAWS OF MARYLAND                         [CH. 604

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 699B be and it is hereby added to the Code of
Public Local Laws of Prince George's County (1953 Edition, being
Article 17 of the Code of Public Local Laws of Maryland), title
"Prince George's County," subtitle "Gaming," to follow immediately
after Section 699A thereof, which section was last amended by Chap-
ter 780 of the Acts of 1961, and to read as follows:

699B.

(a)   It is unlawful for any person to keep, maintain, set up, have,
possess, operate or manage, or to have any interest in or be concerned
as owner, lessor, lessee, licensor, licensee, principal, agent, collector,
clerk or in any other manner, directly or indirectly, in keeping, main-
taining, setting up, having, possessing, operating, or managing, any
device or machine for which payment of the federal tax specified in
Section 4461 (a) (2) SECTIONS 4461 (A) (2) AND 4462 (A) (2).
of the United States Internal Revenue Code of 1954 as amended is
required.

(b)    Violation of the provisions of this section is a misdemeanor,
and is punishable, upon conviction, by fine not to exceed one thou-
sand dollars ($1,000.00) or by imprisonment not to exceed one year, or
by both fine and imprisonment, for each violation.

Sec. 2. And be it further enacted, That if any provision of this
Act or the application thereof to any person or circumstances is held
invalid, such invalidity shall not affect the other provisions or any
other application of this Act which can be given effect without the
invalid provision or application, and to this end the provisions of
this Act are hereby declared to be severable.

Sec. 3. And be it further enacted, That all laws or parts of laws,

public general or public local, inconsistent with the provisions of this

Act are hereby repealed to the extent of any such inconsistency.

SEC. 3. AND BE IT FURTHER ENACTED, THAT ANY SUCH
MECHANICAL OR ELECTRICAL DEVICE AS REFERRED TO
IN SECTION 1 IMMEDIATELY PRECEDING, OPERATED,
MAINTAINED, SET UP, HAD, POSSESSED OR MANAGED IN
VIOLATION OF THE PROVISIONS OF THIS SECTION SHALL
BE SEIZED, TOGETHER WITH THE MONEY, COINS, TOKEN
OR SIMILAR OBJECTS IN OR ON SUCH MACHINE, AND, UPON
CONVICTION OF ANY PERSON FOR A VIOLATION OF THE
PROVISIONS OF THIS SECTION IN RELATION TO SUCH DE-
VICE OR MACHINE, SUCH DEVICE OR MACHINE AND SUCH
MONEY, COINS, TOKENS OR OBJECTS SHALL BE CONFIS-
CATED AND FORFEITED TO PRINCE GEORGE'S COUNTY
AND SUCH DEVICE OR MACHINE SHALL BE DESTROYED
AND SUCH MONEY OR COINS SHALL BE PAID OVER TO THE
TREASURER OF SAID COUNTY FOR DEPOSIT AS MISCEL-
LANEOUS GENERAL FUNDS OF SUCH COUNTY.

Sec. 4. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate preser-
vation of the public health and safety, and having been passed by a
yea and nay vote supported by three-fifths of the members elected to
