89 his Attorney & prayeth that the afd William to the accon. afd may answerAnd the afd Wm. in his proper person comes & defends the force & injury when &c And afd so as afd against him brought nor can he say but that he is guilty of the premisses afd above upon him Imposed as by the Indictmt. afd it is Alledged and thereof Submits to the Court with Protestation of his innocence Therefore it is Considered by the Justices here to wit at Kent County Court at the Court house in the Town of Chester in said County on the third tuesday of Novemr. being the fourteenth day of said month in the year of Our Lord God seventeen hundred thirty & eight that the afd William pay the sum of One pound ten shills. Currt. money of Maryld. as a fine for Committing the offence afd Also it is Considered by the Justices afd at the time & place afd last mentd. that the said William pay the sum of three hundred Seventy & nine pounds of tobacco Costs Accrueing on the premisses afd to the severall Officers of this &c Ordered by this Court here that the fine afd be delivered to the sher. of Kent County And Simon Wilmer Gent. Sher. of Kent County present here in Court Acknowledgeth the receipt of the Same Ordered by this Court here that the afd Wm. give Security for the Fees Accrueing on the premisses afd to the Officers of this Court Thereupon William Pope of Kent County Labourr and George Garnett of the same County Innholder And present here in Court in their proper persons Acknowledgeth themselves Indebted unto his Lordship the Right honble the Lord propry of Maryld. in the sum of five hundred pounds of tobacco each to be made & Leveyed on their bodys goods & Chattles Lands & Tenements for the use of his said Lordship his heirs & Successors With Condition to this recognize. that William Pope do pay the fees Accrueing on the premisses afd to the Severall Officers of this Court Then this recognize. to be void Else to stand & remain in full force power & Virtue in Law Ordered by this Court here that the afd William Pope enter into recoge. with Security for his Appe. & good behavour to next March Court Thereupon Wm. Pope of Kent County Labourer & George Garnett & Stephen Glanvill of the afd County Inn holders & present here in Court in their proper persons Acknowledgeth themselves Indebted to his Lordship the Right honourable the Lord propry of Maryld.
