And against the peace of God the said Lord Propry his good rule
and Governmt. &c                           J George
On the Back of the afd Indictmt. was Indorsed as fol. Vizt.
           Billa Vera pr. John Brown foreman Grand Jury
And now here to wit at Kent County Court at the Court house
in the Town of Chester in said County on the third tuesday of Marchr.
being the twentyeth day of said month in the Year of Our Lord
seventeen hundred thirty and eight Cometh the afd Lord Propry
by Josa. George his Attorney and prayeth that the afd Maths.
to the Indictmt. afd may Answer            And the afd Maths.
in his proper person comes & defends the force & injury when
&c And saith that he cannot gainsay the Indictmt. afd so as afd
against him brought nor can he say but that the he is guilty of
the premisses afd above upon him Imposed as by the afd
                                                               Submits
Indictment it is Alledged and thereof he puts ^ himself upon to
the Courtry &c            Therefore it is Considered by the
Justices here to wit at Kent County Court at the Court house in
the Town of Chester in said County on the third tuesday of
March being the twentyeth day of said month in the year
of Our Lord Seventeen hundred thirty & eight that the afd Maths.
pay the sum of five shillings Currt. money of Maryland
as a fine for Committing the Offence afd Also it is Considered
by the Justices at the time and place afd last above mentioned
                                                               three
that the same Mathias pay the sum of two ^ hundred and
      twenty Six
forty eight ^ pounds of tobo. Costs Accrueing on the prsses
afd to the Officers of this Court &c            Jams Smith Clk Kt. Coty
Ordered by this Court here that the fine afd be delivered the
sher. of Kent County and Simon Wilmer Gent. sher. of Kent County
present here in Court Acknowledgeth the receipt of the same
Nathll. Hynson Senr. Assumes payment of the fees
Accrueing on the premisses afd to the Officers of this Court
Att which said third tuesday of March being the day & year afd
last mentd. Cometh here into the afd County Court John Hodges in his
proper person and prayeth that his recoge. taken as afd for his Appe.
as an Evide. to the Court agst. Mathias Pooley may be Dischd.
Ordered by this Court here that the afd John Hodges his recoge.
taken as afd for his Appeance as an Evide. as afd be y
Discharged as Prayed            John Hodges his recoge.
taken as afd is by this Court here Discharged there being
no Cause Shewn to the Contrary &c
