in the Town of Chester in said County on the third tuesday of Novr.
being the fourteenth day of said month in the year of Our Lord
Seventeen hundred thirty & eight Cometh the afd Lord Propry by
his Attorney afd And prayeth that the afd John to the Accon. afd may
Answer       And the afd John in his proper Person comes and
defends the force and injury when &c And saith that he cannot gainsay
the Indictment afd so as afd against him brought nor can he say but
that he is guilty of the Premisses afd Above upon him Imposed as
by the Indictment afd it is alledged and thereof Submits to the Court
Therefore it is Considered by the Justices here to wit at Kent
County Court at the Court house in the Town of Chester in said
County on the third tuesday of Novemr. being the fourteenth day of
said month in the year of Our Lord seventeen hundred thirty &
eight that the afd John Thomas pay the sum of ten Shil. Current
money of Maryld. as a fine for Committing the Offence afd Also it is
Considered by the Justices at the time and place afd last mentd.
that the said John pay the Sum of three hundred & ninety One
pounds of tobacco Costs Accrueing on the premisses afd
to the Officers of this Court &c
Ordered by this Court here that the fine afd be delivered the sher.
of Kent County And he the afd John not having wherwithall to
Satisfy the Fine afd Thereupon he is Committed into the Custody
of the sher. of Kent County untill the fine afd be Satisfyed
Ordered by this Court here that the afd John give Security for
the Fees Accrueing on the premisses afd to the Officers of this
Court &c                  Ordered by this Court here that the afd John
enter into Recognize. with Security for his Appearance & good
behavour to next March Court &c
Thereupon John Thomas John Cannaday & Thomas
Catling and present here in Court in their proper person and
Acknowledges themselves Indebted to his Lordship the right
honourable the Lord Propry of the Prove. of Maryld. John Thom[as]
in the sum of twenty pounds Currt. money of the province afd &
be made & Leveyed on John Cannaday & Thomas Catling in the sum
of ten pounds like money each to be made and Leveyed on their bodys
goods and Chattles Lands and Tenements for the Use of his said Lordship
his heirs and Successors With Condition to this recognize. that John
Thomas do make his Personall Appe. before the Justices of Our
next County Court to be held at Our Court house in the Town of Chester in
said County on the third tuesday of March next And in the mean time
to keep the peace & be of good behavr. Then this recognize. to be
Void Else to remain in full force in Law            Jams Smith [Clk] Kt Coty.
