follow immediately after Section 1562A thereof, and to add Section
74-28.2 to the Montgomery County Code (1955 Edition), being
Article 16 of the Public Local Laws of Maryland, title "Montgomery
County", sub-title "Washington Suburban Sanitary District", said
new section to follow immediately after Section 74-28.1 thereof,
amending the Laws of the Washington Suburban Sanitary District
to clarify and make specific the authority and power of the Wash-
ington Suburban Sanitary Commission to adopt and enforce regula-
tions as may be necessary to carry out the provisions of the sub-
title.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 1562B be and it is hereby added to the Code of Public
Local Laws of Prince George's County (1953 Edition), being Article
17 of the Public Local Laws of Maryland, title "Prince George's
County", sub-title "Washington Suburban Sanitary District", to
follow immediately after Section 1562A thereof, and that Section
74-28.2 be and it is hereby added to the Montgomery County Code
(1955 Edition), being Article 16 of the Public Local Laws of Mary-
land, title "Montgomery County", sub-title "Washington Suburban
Sanitary District", to follow immediately after Section 74-28.1 there-
of, and all to read as follows:
1562B. (74.-28.2) (a) Except as otherwise provided by this sub-
title, the Commission is hereby authorized to adopt, formulate and
revise from time to time, and enforce such rules and regulations as
may be necesary NECESSARY to carry out the provisions of this
sub-title and any other laws the enforcement and administration of
which is vested in the Commission. The Commission may limit or
regulate the use and supply of water service, sanitary sewer service,
refuse collection and disposal service and storm and surface water
drainage service, on a temporary basis in any area or to any premise
served by its facilities, as the exigencies of the occasion and the pro-
tection of its systems may require. The Commission shall make such
regulations not inconsistent with law as it may deem necesary
NECESSARY for the public safety, health, comfort or convenience,
in the construction, operation, maintenance, expansion, relocation,
replacement, renovation and repair of its water system, sanitary
sewer system, refuse collection and disposal system and storm and
surface water drainage system. The Commission may fix the forms
of permits and specify the nature, type and amount of information,
detail and engineering data required to be submitted for any permit
authorized or required by this sub-title.
(b) Except for the immediate preservation of the public health
and safety or for emergency provisions required to protect the Com-
mission's systems such rules and regulations, and any revisions there-
of, except those only editorial in nature, shall be promulgated not
less than thirty (30) days prior to their effective date, with notice
being given by publication in at least one newspaper printed and pub-
lished in Montgomery County and one newspaper printed and pub-
lished in Prince George's County.
(c) Any regulation adopted by the Commission pursuant to this
section shall have the force and authority of law, and a violation of
the same shall be a misdemeanor, punishable as are other misde-
meanors under this sub-title, as specified in Section 1601 (74-66).
