PORATED CITY OR TOWN WITHIN ANY COUNTY IN THIS
STATE, and the Mayor and City Council of Baltimore, have the
authority to classify the different types of activities under this sub-
title, and the rate of tax levied need not be the same for each type
of activity.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.

CHAPTER 386

(Senate Bill 325)

AN ACT to repeal and re-enact, with amendments, Section 158 of
Article 56 of the Annotated Code of Maryland (1960 Supplement),
title "Licenses", sub-title "Moving Picture Shows and Carnivals",
generally amending the law concerning the payment of license fees
for certain exhibitions by any automatic moving picture machine,
phonograph, graphophone or similar musical machine in order to
remove therefrom any reference to moving picture shows and
certain other exhibitions.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 158 of Article 56 of the Annotated Code of Maryland
(1960 Supplement), title "Licenses", sub-title "Moving Picture
Shows and Carnivals", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

158.

[That for the exhibition by any automatic moving picture machine,
phonograph, graphophone or similar musical machine, except for
benevolent, charitable or educational purposes, where the price of
admission to such exhibitions is more than 5 cents, the following
license fees shall be annually paid:

Places of amusement having a seating capacity of less than

300, each.........................................................................................................................$ 50.00

Those having a seating capacity of more than 300 and less

than 400, each............................................................................................................ 100.00

Those having a seating capacity of more than 400 and less

than 500, each........................................................................................................... 150.00

Those having a seating capacity of more than 500 and less

than 1,000, each......................................................................................................... 225.00

Those having a seating capacity of more than 1,000 each.....„..... 300.00

And where the place of amusement is so constructed that auto-
mobiles can drive in and in which there are spaces for the automobiles
and the patrons can view the moving pictures from the automobiles,
the following license fees shall be annually paid:

Places of amusement having spaces for not more than 100

automobiles..................................................................................................................$100.00
