and approved in writing by the supervisor of assessments of the
county and by the treasurer of the county (in Montgomery County
the director of the department of finance) respectively, decrease or
abate an assessment after the date of finality for any year, whether
a protest against said assessment was filed before the date of finality
or not, in order to correct erroneous and improper assessments and
to prevent injustice, provided that the reasons for such decrease or
abatement shall be clearly set forth in such order.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.

CHAPTER 188
(House Bill 8)

AN ACT to repeal and re-enact, with amendments, Section 46 of
Article 77 of the Annotated Code of Maryland (1957 Edition), title
"Public Education", sub-title "Chapter 4. State Superintendent of
Schools", relating to the professional assistants in the Department
of Education.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 46 of Article 77 of the Annotated Code of Maryland
(1957 Edition), title "Public Education", sub-title "Chapter 4. State
Superintendent of Schools", be and the same is hereby repealed and
re-enacted with amendments so as to read as follows:

46. The State Department of Education shall hereafter be pro-
vided with [the following] professional assistants as in this section
provided.
Such professional assistants as are employed at the time
this section shall take effect shall be eligible for reappointment to the
positions which they now hold:

(1) A deputy State superintendent of schools who shall represent
the State Superintendent of Schools in the latter's absence and who
shall perform such other duties as may be assigned to him by the
State Superintendent of Schools.

[(l)] (2) An assistant State superintendent of schools, who [shall
represent the State Superintendent of Schools in his absence,] shall
have charge of the office of the Department, the correspondence,
publications, records, reports, and educational and financial statistics;
shall audit the accounts of the county boards of education, and shall
perform such other duties as may be assigned to him by the State
Superintendent of Schools.

[(2)] (3) A supervisor of high schools, who shall have super-
vision of State-aided high schools, shall aid the instructors in all
other schools above the seventh grade and shall perform such other
duties as may be assigned to him by the State Superintendent of
Schools.
