That Sections 604, 605, 609, and 613 of Article 43 of the Annotated
Code of Maryland (1957 Edition), title "Health", subtitle "Physical
Therapy", be and they are hereby repealed and re-enacted, with
amendments, to read as follows:
604. [Physical therapy is defined for the purpose of this subtitle as
the treatment of human injuries, diseases, or disabilities by means
of the healing properties of exercise, massage, ultra-violet rays,
mechanical devices, heat, cold, air, light, water, and electricity, but
not by means of Roentgen rays, radium, surgery or drugs.] As
used in this subtitle, the term "Physical Therapy" means the treat-
ment of any disability, injury, disease, or other condition of health
of human beings; or the prevention of such disability, injury, dis-
ease, or other condition of health; and the rehabilitation as related
thereto by use of the physical, chemical, and other properties of air,
cold, heat, electricity, exercise, massage, radiant energy, including
ultra-violet, visible, and infra-red rays, ultra-sound, water, and ap-
paratus and equipment used in the application of the aforegoing,
or related thereto; the performance of tests of neuromuscular func-
tion as an aid to such treatment and including such new methods
in the application of physical therapy as may be approved by the
board. The use of Roentgen rays and radium for diagnostic and
therapeutic purposes, and the use of electricity for surgical purposes,
including cauterization, are not authorized under the term "physical
therapy" as used in this subtitle.
605. [A physical therapist is defined for the purpose of this sub-
title one who:
(a) Treats human diseases, injuries or disabilities by physical
therapy;
(b) Treats only patients diagnosed and referred by licensed medi-
cal doctors;
(c) Treats for fees; and
(d) Meets those requirements regarding experience and train-
ing in physical therapy as set forth in this subtitle.] "Physical
therapist", as defined in this subtitle, means a person who practices
physical therapy.
609. [The said Board shall be and is hereby empowered, after
due notice and hearing, to suspend or revoke any licenses issued,
under the provisions of this subtitle, to anyone who does or attempts
to do any act, or hold himself or herself as being authorized to do
any act as a physical therapist not expressly conferred herein upon
such licensee, or for any violations of this subtitle.]
(a) The Board may refuse to grant a license to an applicant, or
it may suspend or revoke a license on any of the following grounds:
(1) Habitual indulgence in the use of narcotic drugs or other
habit-forming drugs or in the use of alcoholic liquors to an extent
which affects professional competency;
(2) t The treatment or attempt to treat ailments or other health
conditions of human beings by means other than physical therapy;
, EXCEPT WHERE SPECIFICALLY LICENSED TO DO SO.
