Attorneys in Fact", sub-title "State's Attorney", be and it is hereby
repealed, and that a new Section 40 be and it is hereby enacted in
lieu thereof to stand in the place of the section so repealed, and to
read as follows:
40. Salaries and expense allowances of county State's Attorneys.
(a) Generally.—The State's Attorneys in the several counties of
the State shall receive annually the respective salaries set forth for
performing the duties required of them by their respective public
local laws and by the public general laws, and such expenses as are
provided by law and by the current practice in the several counties.
As specified herein, they shall receive annual payments for office,
traveling and other expenses. All payments for salaries and ex-
penses shall be made by the respective counties in equal monthly
instalments unless otherwise specified. The salaries and expenses
are as follows:
(b) Allegany County.—In Allegany County, (1) the State's At-
torney's salary shall be not less than four thousand dollars ($4,000)
and not more than forty eight hundred dollars ($4,800) SEVEN
THOUSAND FIVE HUNDRED DOLLARS ($7,500), in the dis-
cretion of the Board of County Commissioners.
(2) THE STATE'S ATTORNEY MAY APPOINT A DEPUTY
STATE'S ATTORNEY WHOSE SALARY SHALL BE AS SET BY
THE COUNTY COMMISSIONERS OF ANNE ARUNDEL COUN-
TY, BUT NOT LESS THAN $6,000 ANNUALLY. (3) THE
STATE'S ATTORNEY MAY APPOINT AN ASSISTANT STATE'S
ATTORNEY WHOSE SALARY SHALL BE AS SET BY THE
COUNTY COMMISSIONERS OF ANNE ARUNDEL COUNTY,
(2) The salary of the assistant State's Attorney shall be not less
than three thousand dollars ($3,000).
(2) THE STATE'S ATTORNEY MAY APPOINT A DEPUTY
STATE'S ATTORNEY, WHOSE ANNUAL SALARY SHALL BE
NOT LESS THAN SIX THOUSAND ($6,000) DOLLARS.
(3) THE STATE'S ATTORNEY AND THE DEPUTY STATE'S
ATTORNEY, OR EITHER OF THEM, SHALL PRESENT CASES
TO THE GRAND JURY AND PERFORM SUCH OTHER ACTS
AND DUTIES IN RELATION TO THE GRAND JURY, THE CIR-
CUIT COURT AND MAGISTRATES AS ARE NECESSARY AND
PROPER. IN THE ABSENCE OF THE STATE'S ATTORNEY,
THE DEPUTY STATE'S ATTORNEY SHALL HAVE THE SAME
LEGAL POWERS AS THE STATE'S ATTORNEY TO REPRE-
SENT THE STATE BEFORE GRAND JURIES AND IN THE
TRIAL OF CRIMINAL PROCEEDINGS.
(c) Anne Arundel County.—In Anne Arundel County, (1) the
State's Attorney's salary is seventy five hundred dollars ($7,500)
TEN THOUSAND DOLLARS ($10,000).
(2) The State's Attorney is authorized and empowered to appoint
an assistant State's Attorney, whose salary shall be not less than
thirty-six hundred dollars ($3,600). In special cases, the judge of
the Circuit Court of Anne Arundel County may appoint a special
assistant State's Attorney, whose compensation shall be set by the
Court.
