CHAPTER 770
(House Bill 647)

AN ACT to repeal and re-enact, with amendments, Section 5 (a) of
Article 38 of the Annotated Code of Maryland (1960 Supplement),
title 'Tines and Forfeitures", and to add new Section 61A to the
Code of Public Local Laws of Howard County (1957 Edition, being
Article 14 of the Code of Public Local Laws of Maryland), except-
ing Howard County from the law requiring one-half of the fines im-
posed by county circuit courts to be used for augmentation of the
libraries of said courts, and requiring the county commissioners of
Howard County to appropriate a certain sum annually for the
maintenance of the Howard County Bar Library.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 5 (a) of Article 38 of the Annotated Code of Maryland
(1960 Supplement), title "Fines and Forfeitures", be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

5.

(a) One half of the fines imposed and recognizances forfeited to
the circuit court for the several counties of the State, shall be paid
to the clerks of the respective courts, to be expended under the direc-
tion of the judge or judges of said courts, for the augmentation of the
libraries of said courts, and one half of the fines and recognizances
received by the city treasurer of Baltimore City from the justices
of the peace in Baltimore City and the Sheriff of Baltimore City, as
adjudged by and accruing in the criminal courts of Baltimore City,
and collected and received by or through the said sheriff, shall be paid
by the city treasurer to the Library Company of the Baltimore Bar for
its use and benefit, said sum to the Library Company of the Baltimore
Bar not to exceed, however, in any year the sum of twenty thousand
dollars ($20,000.00). This section not to apply to Queen Anne's, Anne
Arundel, Howard and Talbot counties. No commission or charge shall
be paid to any clerk of the court for collecting and paying over said
fines. In Baltimore County, this section shall not apply to fines im-
posed in gambling cases.

Sec. 2. And be it further enacted, That new Section 61A be and it
is hereby added to the Code of Public Local Laws of Howard County
(1957 Edition, being Article 14 of the Code of Public Local Laws of
Maryland), to read as follows:

61 A.

The Board of County Commissioners of Howard County are hereby
authorized and directed to appropriate annually for the maintenance
and support of the Howard County Bar Library the sum of two thou-
sand ($2,000) dollars, payable quarterly to the clerk of the Circuit
Court for Howard County.
