All buildings on a farm and on any premises devoted solely to
agricultural pursuits are exempt from the provisions and the applica-
tion of both building and housing codes.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.

CHAPTER 142
(Senate Bill 267)

AN ACT to repeal and re-enact, with amendments, Section 5 (c) of
Article 59 of the Annotated Code of Maryland (1960 Supplement),
title "Lunatics and Insane", sub-title "Lunatic or Insane Paupers",
to provide for the determination of the liability of parents, spouses
or children for persons committed to State mental hospitals.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 5 (c) of Article 59 of the Annotated Code of Maryland
(1960 Supplement), title "Lunatics and Insane", sub-title "Lunatic
or Insane Paupers", be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

5.

(c) [It is the intent of Sections 4, 5, and 6 that a husband may be
liable for the support of a wife while she is an inmate of any such
institution; a wife, for a husband; a father or mother, or both, for a
son or daughter; and a son or daughter, or both, for a father or
mother.] The liability under Sections 4, 5, or 6, herein of a husband

for the support of a wife while she is an inmate of any such insti-

tution; a wife, for a husband; a father, or mother, or both, for a son

or daughter; and a son or daughter, or both, for a father or mother,
shall be determined by the Department under rules and regulations
made pursuant to the
Administrative Procedure Act, Sections 244 to

256, inclusive, of Article 41 of this Code, as amended from time to

time. The rules and regulations shall provide for a determination of
what shall constitute abandonment of any of the persons mentioned
above by any other of the persons mentioned above. No liability under

Section 4, 5 or 6 herein shall be placed upon any person mentioned

above for the support of any other of the persons mentioned above

abandoned by the person for whom support is sought. ; HOWEVER,
NO LIABILITY UNDER SECTIONS 4, 5, OR 6 HEREIN SHALL
BE PLACED UPON ANY SON OR DAUGHTER FOR THE SUP-
PORT OF A FATHER OR MOTHER BY WHOM THE SON OR
DAUGHTER HAS BEEN ABANDONED OR UPON ANY HUS-
BAND OR WIFE FOR THE SUPPORT OF A SPOUSE BY WHOM
THE HUSBAND OR WIFE HAS BEEN ABANDONED. THE DE-
