prisoner, and the Workmen's Compensation Commission in determin-
ing the amount, if any, of any such permanent partial or permanent
total disability of any such prisoner shall consider the amount or
percentage of such permanent partial disability or permanent total
disability as of the date of discharge of such prisoner from said
institution.
(c) Upon the death of any prisoner resulting from accidental
injuries arising out of and in the course of his employment within
the meaning of this article his dependents shall be entitled to com-
pensation as determined by this article and based upon the average
weekly wages as hereinbefore defined.
(d) The provisions of this section apply only in the counties of
Frederick, Wicomico, ANNE ARUNDEL, HARFORD and Worcester.
[35A. The provisions of Section 35 shall apply to any prisoners
working for the county roads board or the board of county commis-
sioners of Wicomico, Frederick or Worcester counties.]
Sec. 2. And be it further enacted, That Section 212 (e) of Article
89B of said Code (1957 Edition), title "State Roads", sub-title "Con-
vict Labor", be and it is hereby repealed.
Sec. 3. And be it further enacted, That new Section 188A be and
it is hereby added to Article 41 of said Code (1957 Edition), title
"Governor—Executive and Administrative Departments", SUB-
TITLE "THE EXECUTIVE DEPARTMENT" to follow imme-
diately after Section 188 thereof, and to be under the new sub-head-
ing "Sundry Claims Board", to read as follows:
188A. (e) A "Sundry Claims Board" is created for the purpose
of administering benefits whenever a prisoner in the Patuxent In-
stitution or in the Maryland Penitentiary, House of Correction, or
any other institution under the supervision of the Board of Correc-
tion (1) is engaged in any extra-hazardous work for which wages
or a stipulated sum are paid by said institution, and (2) sustains a
permanent partial or permanent total disability as a result of said
injury, and (3) this disability incapacitates the prisoner or materially
reduces his earning power in such work. For the purpose of this
sub-title, the terms "extra-hazardous work", "permanent partial dis-
ability," and "permanent total disability" have the meanings which
currently are given to them in Article 101 of this Code, title "Work-
men's Compensation"
(b) In such event, the injured prisoner has the right to file a claim
for compensation under this sub-title, within twelve (12) months
after his release from the institution, and not before such release,
with the "Sundry Claims Board". The "Sundry Claims Board" con-
sists of the Attorney General of Maryland, or his representative,
the Comptroller of the State, or his representative, and the Director
of the Budget, or his representative. The Governor shall designate
one of such members to be Chairman and another to be the Secre-
tary of the Board.
(c) The Board may receive original papers representing claims
against the State of Maryland under this sub-title, for the payment
of which no money has been appropriated. Such claims shall be filed
